Transcription Chatham, or thereabouts for whose examinatChatham, or thereabouts for whose examination hee prayed<br /> Commission to bee decreed the said Budd dissentnge<br /> But the Judges did decree a Commission for his examination<br /> returnable within sixe weekes and savinge the examination and<br /> publication of the said witnes in case hee procure him<br /> to bee examined within that time the Court att<br /> Budds petition did conclude this cause the said<br /> Suckley dissentinge etcetera./. John kendall against the shippe}<br /> called the Peter of Caen}<br /> whereof Peter Losingham is Master}<br /> and her tackle and furniture and}<br /> against the said Losingham and}<br /> all others etcetera Smith ffrancklin} Which day the said ffrancklim<br /> appeared for Henry Daniel<br /> and made himselfe partie for<br /> him and alleadged that the<br /> said shipp the Peter did at the<br /> time of the arrest in this<br /> behalfe made and still doth belonge<br /> unto him and produced for sureties<br /> Thomas Papillon of the parish of Saint<br /> katherine Coleman London merchant and<br /> ffrancis Eccleffeild of the parish of Saint ffaith's<br /> London Stationer whom hee desired to bee receaved<br /> and the said shipp XXX be released from the said<br /> arrest in the presence of the said Smith appearing<br /> for the said John kendall and makinge himselfe<br /> partie for him dissentinge and alleadging that the<br /> cause of the acction Commenced by the said kendall<br /> in this behalfe against the said shippe is for<br /> wages and that the same ought to be summarily<br /> heard and determined and that the giving of<br /> baile to the said action is onlie for the delaying<br /> of the cause and keeping it from hearing Wherefore<br /> hee prayed the same may be summarily heard and<br /> determined the said ffrancklin dissentinge and<br /> prayinge the same may be receaved Whereupon the<br /> Judges did order the same baile to bee receaved<br /> but declared that the receavinge the same shalbee<br /> noe manner of hinderance to the hearinge of the<br /> cause summarily but the same shalbee summarily<br /> heard and determined notwithstanding the said baile<br /> in case this cause ought to have beene summarily<br /> heard before the giving of baile Then the said<br /> Thomas Papillon and ffrancis Ecclesfeild submittinge<br /> themselves etcetera obliged themselves etcetera for the said<br /> Henry Daniell in the summe of Twoe hundred<br /> poundes of lawfull money of England to the said John<br /> kendall to answeare the action by him commenced<br /> against the said shippe and to pay what the said<br /> Daniel shalbee condemned in woth expensces of suite<br /> in case hee shalbee overthrowne and to bringe forth<br /> the said Daniel in Judgement whensoever his presence<br /> shalbee thereunto required And unles etcetera Which<br /> Caution the Judges receaved and decreed the said<br /> shipp to bee released from the arrest Then the said<br /> Smith exhibited and left in the Registry of this <br /> Court a certaine writinge in parchment and<br /> alleadgednge in parchment and<br /> alleadged  +
