Transcription the nyneteenth day of October anno domini the nyneteenth day of October anno domini 1635 last past the arlate John<br /> Digbye did buy of him this deponent two cases of stronnge waters<br /> which (as the sayd Digbye then affirmed) he intended to send to Virginia<br /> in the arlate shipp the ''Constant'' (Wherof Clement Campion was<br /> captain for which two cases of stronnge waters the said Digbye hath since really payd unto<br /> him forty two shillings seaven pence, And heralsoe<br /> sayeth that tent wyne the time aforesaid (if it were good could not be lesse<br /> worth then foure shillings per gallon; and suche at that tyme (if it were<br /> found) could not be lesse worth then three shillings per gallon, which he know that<br /> to be true beinge a wyne Cooper who doth often buy and sell wynes<br /> Et alr nescit deponere./ Richarde Younge [SIGNATURE, RH SIDE] ****************************************** Primo February 1636 iuxta [?Xe]./ '''Robertus Burges''' de Culliton in County Devon mercator aetats<br /> 42 annorum circiter testis in hac parte productus iuratus<br /> Et examinatus dicit quod Johem Digbye partem productus per<br /> 12 annes aetapps aut circiter bene novit sed partem con quam<br /> productus non novit ut dicit Ad primum secundum et reliquos arlos allegationis in hac parte dat et oblat<br /> Et schedulam in eadem menconat dicit et deponit That<br /> A little before Easter last past he<br /> this deponent beinge heere in London mett with the arlate John<br /> Digbye who acquainted this deponent that he had traded divers goods abord<br /> the arlate shipp the ''Constant'' (wherof the arlate Clement Campion<br /> was captain) to be delivered at Virginia, and that he had understood that<br /> the sayd shipp proved insufficient for the performance of her voyage<br /> and that she was putt into the west countrey neere at Alford combe<br /> neere Barnestaple, and the sayd Digbye delivered this deponent on<br /> divers notes of the particulers of the sayd goods with a letter of attorney under his hands to receive them and desired him to<br /> ride to Alfordcombe to demande the sayd goods, and that in or<br /> about the moneth of May last past this deponent at the request of the<br /> sayd digbye this rode to Barnestaple and there inquired for the<br /> sayd Campion the captain of the said ship, where he was tould that the<br /> sayd Campion was at a gentlemans house about five miles from that<br /> place, and that a great part of the goods laden in the said ship were<br /> sould, and then this deponent rode to that gent house to inquire for the<br /> sayd Campion, where coming he was tould by one of the company of the said ship that doth lay at that gentlemans house that the said Campion had<br /> bene there, but was gone from there the day before and that some of the sayd Digbyes<br /> goods videlicet contayne wynes and other goods lay in that gent house, but this<br /> deponent could not have them unlesse he would pay six pounds for them,<br /> and that all the goods were unladen out of the said shippe, and some of the<br /> sayd goods were in a sellor in Alfordcombe but were much dampuifyed<br /> little worth, and that a great part of the goods laden into the sayd<br /> shipp were sould to mainetayne the company (they having nothing else to<br /> live on) and to pay their debts in that countrey wheruppon this deponent<br /> replyed that he had authoritye to receive the sayd Digbyes goods, but not to<br /> pay any money for them, and then that man of the company agayne tould him that he<br /> could not have those wynes and other goods unlesse he would paye six pounds for them<br /> and theruppon this deponent returned home and did not goe to Alfordcombe to demand<br /> the rest of the said Digbyes goods because he was tould that they were spoiled, dampuifyed and little<br /> worth as aforesaid Et alr profit deponere.
