Transcription Idem ad Interrogatoria ex parte Avery et [Idem ad Interrogatoria ex parte Avery et [?seXXX] dat<br /> et ministrat./ To the 1st and 2d Interrogatories hee answereth negatively saying<br /> that Captaine Ellison was to his knowledge perswaded by the interrogated<br /> Symon Bayly James Parrott and others not to fire at the ffrench before<br /> they could knowe what they intended. To the 3d Interrogatorie hee saith that the ffrench man of warr did laie<br /> the said ship the ''Pearry'' abord upon her quarter att which tyme hee<br /> saith the said Captaine Ellison was as hee remembreth in the Great<br /> Cabbin of the said ship the ''Pearry''. And otherwise then as aforesaid<br /> hee cannot answere or deposeth. To the 4th hee answereth negatively referring himselfe to<br /> his former deposition. And otherwise cannot answere or depose. To the 5th hee answereth negatively for his part. To the 6th hee answereth negatively. To the 7th hee saith that Mr Avery was wounded and John<br /> dyet was a little bruised in the said fight. And likewise saith<br /> that Captaien Ellison had a blowe with a bullet or a splinter<br /> upon one of his Buttoches. And as for John Kennett hee<br /> saith hee was sicke both before and after the said fight and soe<br /> was not wounded therein. And otherwise hee answereth<br /> negatively saying that about 27. or 28. of the said ship the ''Parreyes''<br /> Companie have voluntarily entred them selves into the<br /> service of the ffrench. To the 8th hee saith hee is allmost seaventeene yeares of<br /> age and is not att all afraid of his master, but that hee<br /> will and dare speake the truth in this businesse though it<br /> were never soe much against the said Captaine Ellison, hee<br /> being thereunto required by oath to doe, And saith hee<br /> knoweth soe well what an oath is, and that hee would<br /> not for all the world sweare an untruth<br /> in respect of his owne soulles wellfare in the world to come./ To the 9th hee answereth negatively To the 10th hee cannot answere or depose To the 11th hee referreth himselfe to his former deposition And<br /> otherwise hee cannot depose.
