paying the cash and writing of letters for the said ffairfax and company, but as<br />
hee beleeveth there were above tenn of the said barrells of Indico (soe<br />
received from Sir Jacob Garret shipped aboard the ''Salvadore'' as aforesaid. And<br />
otherwise hee cannot depose, saving the said ffairfax and company wrote<br />
a letter to the said Sir Jacob Garrett in July 1650, signifying that his<br />
Indico's were still in [XXXX], (being the word of the said letter) which letter hee hath<br />
nowe seene and knoweth the hand thereof
To the nineth article of the said allegation hee saith and deposeth that in the<br />
moneth of September last (new stile) there were about 25 barrells of<br />
Indico and other goods laden out of the said warehouse of the said ffairfax<br />
and company aboard the said shipp the ''Salvador'' in the port of Ligorne<br />
aforesaid and hee beleeveth the said 25 barrells to be the Indicoes of<br />
the foresaid Sir Jacob Garret and part of the foresaid 26 barrells and<br />
a halfe, and that after the lading thereof this deponent and others<br />
went aboard the said shipp the ''Salvador'' bound for Civita Vechia,<br />
and the said shipp being in the Roadem, and there lying in expectation<br />
of faire weather to goe for civita vechia, the arlate Robert Swanley<br />
and Nicholas Terrick came in the night time aboard the said shipp<br />
lying in the said Roade of Ligorne, and the said master of the ''Salvador''<br />
Peter whiting being thereupon called forth of the Round house where<br />
hee and this deponent were abedd, they went forth to them, the said<br />
whiting first, and then this deponent, and comming to the said<br />
Swanley and Terrick on the decke this deponent heard the said<br />
Swanley and Terrick say (Speaking to this deponent) your<br />
house is failed (speakingof the said ffairfax and company) and you<br />
knowe that [XXX] are greate creditors therto; wee knowe that you<br />
have Indico aboard and wee must have satisfaction, or words to the<br />
same effect, to which the said whiting and this deponent retourned<br />
answer that if they had an order from mr [?Lister] for delivery<br />
thereof they would deliver it, otherwise not, to which they the said Swanley and Terrick replied<br />
that they must and would have satisfaction, and therewithall<br />
demanded fifteene barrells of Indico, but this deponent tould<br />
them they should have none by his consent unlesse they would give<br />
a receipt therefore and therein expresse that they tooke it by force,<br />
which they promising to give, and this deponent fearing that in<br />
case they were withstood they would indeede take it by force<br />
having their skiffs or boates manned by the shipps side, hee began to write<br />
a receipt to testifie their said forcible taking the same away,<br />
and after hee had written some part thereof, one John harwood<br />
booke keeper to the said ffairfax and company tooke the same out<br />
of his hand and wrote another to the same effect, testifying their<br />
said forcible receipt, which they the said Swanley and Terrick<br />
signed this deponent seeing the same under their hands, and under<br />
the hand of William Jourdain Purser of the shipp the ''henry''<br />
''Bonadventure'' whereof the said Swanley was commander, and<br />
soe the said tenn barrells of Indico were hoi[?sed] out and by the said Swanley and Terrick taken and carried away[XX] said Indico was part of the foresaid 25 barrells) and [XX GUTTER]<br />
by them carried aboard their shipps the ''henry Bonadventure'' and the<br />
''hopewell'' or one of them. And otherwise hee cannot depose, saving hee<br />
sawe the said barrells hoisedout of the ''Salvador'' into the said skiffs<br />
or boates of the said Swanley and Terrick soe lying by the ''Salvadores''<br />
side. And otherwise hee cannot depose.
