but they said they tooke the same away in consideration of what the said ffairfax<br />
and company ought unto them. And otherwise hee cannot depose.

To the last hee saith his foregeoing deposition was and is true.
Examined upon the second allegation in this cause given and<br />
schedules annexed. [INDENTED HEADING]
To the first and second articles of the said allegation hee saith and deposeth that after the lading<br />
of the 25 narralls of Indico (by him redeposed) out of the said ffairfax and<br />
company their warehouse aboard the ''Salvadore'' and after the taking out the foresaid<br />
tenn barralls out of the ''Salvadore'' by the said Swanley and Terrick as<br />
hee hath predeposed, the said shipp ''Salvadore'' saled for civita vecchia<br />
and there arived, and there hee saith the arlate Peter Whit[?inge] master of<br />
the said shipp the ''Salvador'' and his boatswaine were examined concerning the<br />
said tenn barr[?e]lls of Indico, and their examinations and confessions<br />
upon oath, were put into writing and by them subscribed<br />
and there attested inder the hand of a Notary publique there resident,<br />
which hee knoweth because hee was present at the said subscription by the<br />
said witnesses and sailed to civita vecchia in the said shipp. And saith that<br />
the [?Fede] or schedule annexed (nowe showed unto him) in vulgar Italian<br />
was and is the originall of the said depositions, and otherwise hee cannot<br />
depose.
To the third hee cannot depose.
To the Interrogatories [CENTRE HEADING]
To the first hee saith hee cometh to testifie the truth in this cause at<br />
the instance of Sir Jacob Garret, and saith that hee would rather give<br />
the victory in this cause to the parties defendant than to the<br />
said Sir Jacob Garrett, because hee hath friends amongst them and Sir<br />
Jacob is a stranger unto him, howbeit hee hath spoken the truth herein<br />
(as hee saith) without partialiti[?a].
To the second hee saith hee expecteth noe benefit if Sir Jacob Garrett prevaile<br />
in this sut[?a], nor losse if hee be overthrowne, and otherwise negatively.
To the third hee saith hee did not see any of the Indicos arlate aboard<br />
the ships the ''Arabella'' and ''Prosperous'', nor sawe the lading thereof aboard<br />
those shipps, nor knoweth the time of the lading thereof aboard them, hee<br />
being then at Lig[?a]rn[?a] or other parts of Italy.
To the fourth hee saith that hee was at Ligorne and resided there about five<br />
yeares from November 1645 at which time hee first came thither. And<br />
saith that first the company of the said ffairfax (in his this deponents time) were<br />
the said ffairfax and Thomas Barnesly merchant, and afterwards<br />
upon the death of the said Barnesley and when the foresaid Indicoes came<br />
and arived at Ligorne from London, the said ffairfax, martin Lister and<br />
humfrey S[?X]d[X]y were the company, and that the said Sir Jacob Garrett his<br />
Indicos were consigned to the said ffairfax and company to be by them sold if<br />
they could arive at such a price as hee the said Sir Jacob prefixed, and<br />
otherwise hee cannot answer saying that the said ffairfax and company whilest hee<br />
lived with them as aforesaid never sent the [?worth] of a penny in goods to the<br />
said Sir Jacob that hee this deponent knoweth of. And otherwise saving his<br />
foregoeing deposeition hee cannot answer.
To the fifth hee referreth himselfe to his foregoing deposition and otherwise cannot<br />
