Transcription dad was in the full absolute and quiet posdad was in the full absolute and quiet possession thereof<br /> All which he knoweth to bee true because hee this deponent was present at<br /> dunquirke when the said dad soe bought the said ship the ''Adventure'' and<br /> from thence came home in her to Plymouth together with the said producent<br /> And further hee cannot depose. To the second Interrogatorie hee saith and deposeth that the said ship the<br /> ''Adventure'' in or about the moneth of Aprill 1643 being comeing home<br /> from Cadiz and Saint Lucar for London was taken at Sea by an Irish Man<br /> or warre who caryed her to Waxford in Ireland, at which tyme the said<br /> ship was laden with Sugars and oyles And with that after such the<br /> seizure of the said shipp shee was by the takers thereof sold to some Irish<br /> Merchants who sett her forth againe from Waxford for Cadiz laden with<br /> Butter Tallow hides beefe pipe staves and Salmon but the said<br /> ship in her said voyage being mett with off the Southward Cape<br /> by the interrogated William Ashley shee was with her said ladeing by<br /> him taken and carryed to Leghorne where the same was by him sold<br /> and disposed of as his owne goods The premisses hee deposeth because hee<br /> this deponent being a Quarter master of and in the ''Raynboe'' was in the said<br /> ship at Sea nere the ship the ''Adventure'' when the said Ashley seized<br /> her and mett him att Sea and sawe her in his possession, and the next<br /> yeare after this deponent goeing to Leghorne hee did there see the said ship<br /> the ''Adventure'' in the possession of such persons as the said Ashley had sold<br /> her unto And further hee cannot depose, saveing that this deponent<br /> sawe the said ship at Waxford ymediatly after shee was seized<br /> by the said Irishe man of warre and before shee was sett out from<br /> thence for Saint Lucar. To the third Interrogatorie hee saith and deposeth that the said ship the ''Adven=''<br /> ''ture'' soe seized by the said Irishe man of warre and retaken by the said<br /> Ashley was and is the very same ship which did belong unto the said dad<br /> and which hee soe as aforesaid bought at dunquirke And soe much hee<br /> saith was comonly said and reported by and amongst severall persons at Leghorne<br /> who very well knew her And saith that hee this deponent met the said Ashley<br /> with the said shipp off Carthagina and spoke with him and was abord him and<br /> then the said Ashley gave Captaine [?Crawder] the comander of the said ship the<br /> ''Raynebowe'' in which this deponent then was fower Salmon and a Cable out of the said<br /> ship the ''Adventure'', which hee then know to bee the said producents shipp<br /> by her [XXdd] Galleryes and her s[?nooke]head and by many other signes<br /> and tokens which this deponent had taken notice of in his former knowledge of her<br /> which hee saith was by the space of neare Twenty yeares before she<br /> was by the said dad soe bought at dunquirke. And further hee cannot<br /> depose. To the fowerth Interrogatorie hee saith hee cannot depose. To the crosse Interrogatories. [CENTRE HEADING] To the first and second Interrogatories hee saith hee hath knowne the interrogated William Ashley by [?the GUTTER]<br /> space of about 12 yeares and before hee was commander of the ''Sampson'' And [?sayth GUTTER]<br /> hee neither oweth the producent any thing nor is hee indebted unto this deponent and<br /> hee favoureth both parties alike and that hee hath noe share or interest<br /> in the said ship the ''Adventure'' nor shall hee as hee saith either get or loose one<br /> penny by this busines whichsoever of the parties litigant prevaile. And<br /> otherwise hee answereth negatively.
