Transcription To the fifth article hee saith and deposetTo the fifth article hee saith and deposeth that the said boyer the ''dove'' soe laden<br /> with corne, bound for London and seized by the Scotch man of warr and the vessell or<br /> boyer aforesaid laden with wheate and rescued by the ''Assistance frigot'' and brought<br /> into Leith in Scotland were the same boyer and corne and not diverse, yeelding in<br /> reason of his knowledge as aforesaid. And otherwise hee cannot depose. To the sixth hee saith that the said Lucas Jacobs was and is an Inhabitant of this<br /> citie of London and a subiect of this CommonWealth and soe commonly accompted<br /> and otherwise cannot depose. To the last hee saith that his foregoeing deposition was and is true. To the Interrogatories. [CENTRE HEADING] '''Rowe dt.''' To the first heee referreth himselfe to his foregoeing deposition and otherwise answereth<br /> negatively. To the second, third fourth 5 and 6th hee referreth himselfe to his foregoing deposition and<br /> otherwise cannot answer, savinge that the said frogot the ''Assistance'' rescued the<br /> said boyer and lading off Mo[XX]resse on the coast of Scotland as the company of the said Scots man<br /> were carrying her along for Aberdane, her master and company being dispossest<br /> and dispoiled of the possession and command of her, and only this deponent and his<br /> contest John holdewick and a boy of her company left in her, and six of the<br /> Scots mans company being aboard her when shee was rescued, soe that the said boyer<br /> and lading of wheate had bin lost to the owners if the said rescue had not bin made,<br /> only the said Scotsman told the Skipper before hee carried him out of his said boyer<br /> that hee should have the same againe and his freight, but the lading should be<br /> made prize because it was bound for London. To the 7th hee saith that it was about 9 of the clock in the morning of the said 30th<br /> of Aprill that the said Scotsman tooke them, and about 6 in the morning of the 5th<br /> of May last that the ''Assistance'' rescued them. To the 8th 9th and 10th hee answereth negatively, saving as aforesaid. To the 11th and 12th hee cannot depose saving as aforesaid. To the first article of the said allegation hee saith and deposeth that hee well knoweth<br /> the producent Lucas Jacobs of London merchant, and saith that hee the said<br /> Jacobs and company were the time arlate and are the true and lawfull<br /> owners and proprietors of the lading of wheate aboard the boyer of hamborough<br /> arlate and soe commonly accompted, which hee knoweth because Abraham<br /> Stockman of hamborowe laded the same for that accompt at hamborowe<br /> and both hee and the Skipper Otto Pape did there at the time of the lading<br /> thereof severall times say and declare that the said wheate was for the accompt<br /> of the said Jacobs and companie in the presence and hearing of this deponent<br /> one of the company of the said boyer.
