To the fourth article of the said Allegation hee saith and deposeth That after the<br /> said producents Cogia Jacomo and Cogia Kamar had soe laden the said goods<br /> schedulated mentioned in the said two schedules abord the said shipp the ''Saint Martyn''<br /> the said ship did depart therewith from Smyrna directly for Leghorne And the<br /> said producents themselves did then allsoe goe along with theire said goods in the<br /> said shi[ to looke unto them and with them tooke the said bills of loading allso<br /> And saith that the said ship as shee was in her said Course from Smyrna<br /> for Leghorne off the Ile of Corsica about 146 dayes since was mett withall<br /> surprized and taken by a Squadron of Ships which were in the ymediate service<br /> of the Parliament of England under the Comand of Captaine Hall and others att which<br /> tyme the said producents had the said bills of loading and goods therein mentioned in theire owne custodie<br /> and possession All which hee knoweth to bee true because hee this deponent<br /> did come from Smyrna in the said ship the ''Saint Martin'' together with the said producents<br /> and sawe the said seizure made of the said ship and did allsoe then see the said<br /> parties have the said bills of lading in theire possession, which at that tyme they<br /> put into theire sandalls or shoes and being afterwards turned ashore upon an<br /> Iland neere Trapany they brought them hither with them, this deponent allsoe<br /> comeing along in theire Companye. And further hee cannot depose To the 5th article of the said Allegation hee saith and deposeth That the said<br /> Cogia Jacomo is a Merchant descended from Armenia but living in Spahan<br /> in Persia and the said Cogia Kamar hee saith is of Bursia which is a Cittie<br /> under the dominions of the Turkishe Emperoure but [XXXXXX XXXXX] ?likewise] and both of them hee saith have<br /> and doe usually trade [?at] other parts where they [?live] to Smyrna and from thence to<br /> Leghorne where they have f[XXX] corrispondency and Commerce with diverse<br /> Englishe Merchants all [XX] which hee knoweth because hee hath knowne both<br /> the said parties producent for diverse yeares last past together and hath<br /> knowne and used the same trade with them into and from the parts predeposed<br /> And further saith that the said Jacomo is a subiect of the King of Persia and<br /> the said Kamar of the Turkish Emperour betwixt both which XXXXX] and this<br /> Commonwealth by comon and generall repute there is and at the tyme of the<br /> seizure of the said ship was peace, and Amitye, and a comon trade and<br /> Commerces of this deponents knowledge. And farther hee cannot depose. To the last article hee saith that what hee hath predeposed is true. To the Crosse Interrogatories [CENTRE HEADING] To the first Interrogatorie hee saith that hee this deponent came first aboard<br /> the said ship the ''Saint Martin'' at Smyrna and was only a Merchant abord<br /> her in this her late voyage in which shee was seized; Touching further<br /> answere to this Interrogatorie hee referreth himselfe to his foregoeing deposition<br /> in which hee hath given full satisfaction hereunto And further cannot depose To the second Interrogatorie hee saith that hee hath knowne the said Cogia Jacomo<br /> by the space of theise 25 yeares and even from his infancye and the said<br /> Cogia Kamar by the space of theise 8 yeares or thereabouts. And saith<br /> that hee this deponent is a Persian by Birth and was borne in Spaham aforesaid<br /> where the said Jacomo was also borne And the said Kumar hee saith liveth<br /> in the Citty of Bowrsea aforesaid and is a subiect to the Turkish<br /> Emperourubiect to the Turkish<br /> Emperour  +
