Transcription the Councell of State arlate and to the Rethe Councell of State arlate and to the Registrie of this court<br /> And otherwise hee cannot depose saveing that of his this deponents knowledge<br /> the sais Thomas Awres did by vertue of the said order and a Comission<br /> under the great Seale of this Court (which this deponent hath seene and heard<br /> read over) sett out and imploy the shipp the ''Harry'' of London<br /> arlate to and for the purpose and effect arlate which hee knoweth because<br /> hee this Examinate was and still is one of the Masters mates of the said<br /> ship in this voyage and imployment. And otherwise hee cannot depose. To the second article of the said Allegation hee saith and deposeth That in or<br /> about the moneth of July last past the said ship the ''Harry'' was<br /> and remained in the harbor of Nor Berghen in Norway and dureing such her<br /> abode there hee saith the ship the ''Arke of Noah'' arlate was then at that<br /> place takeing and receaveing on bord her the horses or Mares which [XX XXXX XXX] the<br /> ''Harry'' afterwards tooke in her which said Horses as the generall rumor and<br /> report was then ashore at Nor Berghen and as the merchants who laded them there<br /> did acknowledge and confesse unto this deponent and unto his contests<br /> Jerome Miller and Thomas Hall and others of the ''Harryes'' Company[?a]<br /> in a Scotch house upon the 26th day of July last) were from thence to bee transported in the said<br /> ship unto Aberdeene or dundee in Scotland for the use of the King of<br /> Scotts who then was in Actuall Armes against the Parliament of England. And otherwise hee cannot depose. To the third and fourth articles of the said Allegation hee saith and deposeth<br /> That ymediatly after such tyme as the said producent Thomas Awres<br /> had seized and surprized the ship the ''Arke of Noah'' arlate abd<br /> Horses abord her (which was upon the 28th day of July last.) the said<br /> Merchant who laded the said horses abord her at Nor-Berghen<br /> being abord the ''Harry'' did then and there proffer the said Awres<br /> a hundred dollars to convay him with the said horses to Dundee<br /> or Aberdeene aforesaid in Scotalnd to wither of which ports or places hee<br /> then said hee was bound to discharge his said Horses to and for the use<br /> of the King of Scotland, The said Merchant thinking the said<br /> ship the ''Harry'' to bee a Scotts man of warre because that when she rode<br /> at the Harbour at Nor=Berghen she had and wore the King of Scotts co[X]llours)<br /> And saith that at the tyme of the seizure of the said ship the ''Arke of Noah''<br /> shee was in her direct course for Scotland and quite out of her<br /> way for Hollsten which hee knoweth to bee true because hee this deponent<br /> was masters mate abord the ''Harry'' when she seized the said ship the<br /> ''Arke of Noah''. and was present in the producents Cabbin when the said<br /> Merchant voluntarily said and acknowledged hee was bound for Scottland and did<br /> allsoe heare the skipper and diverse others of the said ships company then and there say and acknowledge<br /> as much. And further hee cannot depose saveing that at such tyme<br /> as the said ship the ''Arke of Noah'' was seized the said Townes of dundee<br /> and Aberdeene were generally reputed to bee in Actuall Armes against the<br /> Parliament of England. To the 5th and 6th articles. hee saith and deposeth That at such tyme as<br /> the said Thomas Awres soe seized and tooke the said ship the ''Arke of Noah''<br /> hee did in this deponents presence and hearing demand of the Marchant and<br /> Skipper of the said shippe where there cocquetts and bills of ladeing<br /> were whereunto thay replyed that thay had none and that thay<br /> needed had none and that thay<br /> needed  +
