Transcription put on bord the shippe the ''Morning Starrput on bord the shippe the ''Morning Starre'' arlate<br /> for the account of the said John Moller to bee carryed and transported<br /> from thence to Ostend or dunquirke and there to bee delivered<br /> to the arlate Phillip de Papa for the use and accompt of the<br /> said John Moller which hee knoweth for the reasons by him in his<br /> deposition to thetwo next followeing articles expressed to which he referreth And further cannot depose. To the fowerth and 5th articles of the said Allegation and to the bill of ladeing<br /> annexed to the said 5th article and now showed unto him hee saith and<br /> deposeth That upon the ladeing of the said silver soe marked as aforesaid<br /> on bord the said shippe the ''Morninge Starre'' the said Jacinto Neimart<br /> did write a letter unto the arlate John Moller thereby advertiseing him<br /> that hee had laden the said Packs and barre of silver soe marked as aforesaid<br /> abord the said shippe the ''Morninge Starre'' for his accompt and that hee had<br /> inclosed in the said letter sent one of the bills of ladeing which the<br /> arlate Michael Van Lubkin did upon the ladeing thereof signe at<br /> Cadiz. which said bill of ladeing hee saith was and is the same which is now<br /> annexed to the said Allegation. and which came inclosed in the said Letter in<br /> another Packett of letters directed to the the (sic) arlate George Boschart, which<br /> being sent overland from Cadiz into ffrance was from Rouen in Normandy<br /> sent hither to the said Seignior Boschart, who was then in England and<br /> had soe bin for severall weekes before. And saith that, after the said ship<br /> was from Cadiz departed towards Ostend with the said silver on bord hee the<br /> said Jacinto Neimart did write more letters over land into fflanders thereby<br /> intimateing that hee had dispatched away the said ship with the said silver<br /> for his account, which being receaved by the said John Moller who<br /> then had advice that the same was taken by some of the English ffleete and<br /> was brought in hither hee did therefore write over from<br /> Antwerpe to the said George Boscart heare in London thereby desireing<br /> him that if hee had any letters in his packet directed from Spaine<br /> which concerned his interest in the silver laden abord the ''Morning Starre''<br /> that hee would breake open the same and endeavour to gett restitution thereof<br /> which said letter was by the said George Boscart receaved who did<br /> thereupon in this deponents sight and presence break [?open] the said<br /> Neimanets letter directed to the said John Moller [?within ?which] the bill<br /> of ladeing annexed was enclosed. which said letter this<br /> deponent read over and hath the same now with him, And thereby<br /> cometh to knowe the premisses to bee true as is predeposed<br /> And further cannot depose. To the 6th and 7th articles of the said Allegation hee saith that the<br /> said ship the ''Morning Starre'' as she was in her course from Cadiz<br /> towards Ostend with the said silver abord her was and is taken and<br /> brought into this Port of London by some of the ships of this<br /> Comonwealth. And saith that the said silver and Plate now claymed<br /> in this cause was as hee verily beleeveth and in his conscience is perswaded<br /> for the reasons aforesaid provided and laden abord the said ship by<br /> the said Jacinto Neimar[?XX]t for the sole and propper account of the<br /> said John Moller who doth alone runne the Riscoe and hazard<br /> thereof.
