of the second marke and countermarked with the third}<br />
marke in the Margent Laden aboard the Shipp the}<br />
''Sampson'' whereof Octavio George is Master [?XXXed] by}<br />

34 yeares a witness sworne and examyned<br />
in this Cause deposeth as followeth
To the first article of the said allegation he sayeth and deposeth That he hath well knowne the arlate<br />
Anthony Rodriques and ffrancis Machado for theis sixe yeares last past or thereabouts<br />
dureinge which time the forsaid Roderigies hath lived att Cadiz and ffrancis Machado<br />
hath lived commonly att Port Saint Mary neare Cadiz and have there maniteyned theire<br />
wifes and ffamilyes [?and] [?hee] sayeth That about the moneth of May last<br />
past the forenamed Rodriguez and Macado beinge then att the Port of<br />
[?Marcaraco] in the West India did come with him this deponent in the Shipp called<br />
''Nostra Seignora del Rosario'' to Cadiz in Spayne where they arrived about the<br />
moneth of September last but sayeth that the said Anthony<br />
Roderigues and ffrancis Machado arlate for theire perticuler and respective Accompts<br />
in or about the moneth of October 1652 arlate did cause to be laden aboard the shipp<br />
the ''Sampson'' arlate lyeinge att or neere Cadiz in Spayne twelve Pattachoes<br />
tobacchoe of the second and third marke in the margent which were to have beene from<br />
thence transported in the said Shipp the ''Sampson'' to Oastend (sic) which hee knoweth to be<br />
true for that hee this deponent sawe the said Tobacchoes laden at Cadiz afforesaid aboard<br />
the said Shipp wherein the forenamed Roderigues and Machadoe came as passengers<br />
from Spayne for Oastend And further to this article saveinge his subsequent depositions<br />
hee cannot depose saveinge that the said Roderigues and ffrancis Marchado were and are<br />
reputed and commonly accompted Lawfull owners and Proprietors of the said Tobacchoes
To the second article hee sayeth and deposeth That within the tyme predeposed hee was present<br />
att Cadiz afforesaid when the arlate Octavio George Master or Comannder of the ''Sampson''<br />
arlate did signe the originall Bill of Ladeinge arlate uppon the lading of the Tobacchoes<br />
predeposed which hee sayeth with twoe others besides the Bill of Ladeing arlate<br />
was signed as afforesaid before the said Shipps departure from Cadiz uppon the voyage<br />
predeposed andfurther cannot depose
To the 3d article hee sayeth and deposeth That for all the tyme predeposed The forenamed<br />
Anthonie Roderigues and ffrancis Macchadoe were and yett are commonly reputed natives<br />
of the Kingdome of Spayne and subiects of hs Catholique Maiesty And further hee cannot<br />
depose saveinge That in the said shipp the ''Sampsons'' course from Cadiz to Oastend (sic) arlate<br />
comeing through the English Channell the said Octavio George was commanded by some of<br />
the Parliament of Englands ffleete to come into the downes which hee knoweth ffor that<br />
hee this deponent being aboard an other Shipp called the ''Salvador'' which came in<br />
company with the ''Sampson'' predeposed from Cadiz was likewise stayed and commannded by the said<br />
[?man] of warr to come into the downes with the said shipp the ''Samposn''<br />
