To the third Interrogatorie hee saith hee … To the third Interrogatorie hee saith hee hath knowne the said shipp ever<br />
since shee was first built which hee saith wsa at the costs of the<br />
said Owners as this deponent verily beleiveth because they have ever<br />
since that tyme imployed her upon severall voyages and designes<br />
as the propper owners thereof. Am otherwise saveing his foregoeing<br />
deposition hee saith hee cannot depose.
To the 4th hee saith that hee knoweth not what moneyes the said owners paid<br />
for the building of tthe said shipp but saith that the said Adrian Yonker is owner<br />
of one 4th part thereof, the said Michael Haushe of one 4th, Joachim Hoyse<br />
of one 8th part. Antonio de Labistraet of 1/8th part, W[?inkle] de Labistraet of one<br />
sixteenth part Cornelius de Hertaugh of one eighth part and the<br />
said Michael Van Lubkin of one 16th part of the said ship the<br />
''Morning Starre''. And otherwise saveing his foregoeing deposition hee<br />
saith hee cannot depose.
To the 5th hee answereth negatively to every part thereof And otherwise<br />
saveing his foregoeing deposition hee saith hee cannot depose.
To the 6th hee saith that the said ship did beginne her present voyage<br />
from Hamborough from whence she sailed to Cadiz, from thence to Gali[?zea]<br />
from thence to Saint Lucar, from thence to Venice from Venice to Cadiz<br />
againe and soe from thence was comeing to Dunquirke at the tyme of<br />
the seizure thereof And otherwise answereth negatively.
To the 7th hee saith that his precontest Michaell van Lubkin hath<br />
bin Commander of the said Vessell by the space of theise five yeares or<br />
thereabouts and was soe constituted by the said Owners thereof<br />
after the death of Joachim Martens who was the next proceeding<br />
Master to the said Van Lubkin with whom this deponent allsoe served on boord<br />
the said shippe And further cannot depose.
To the 8th and nineth Interrogatories hee saith that the said shipp was taken upon<br />
the 5th day of March new stile and that before she was taken did first<br />
by the space of about fower or five howers with the ''Advantage frigot'' interrate<br />
about two leagues distance from the English shore off the beachy which fight was<br />
occasioned because the ''Advantage ffrigott'' when shee discharged the two first<br />
shott at the ''Morning Starre'' did beare and weare the dutch Colours and ffrench<br />
[?Fames] which gave occasion to his precontests and company to thinke her to bee a<br />
ffrench Pirate. And further cannot depose.
To the 10th hee saith that before the fight interrogated this deponent did heare<br />
that there was a difference betwixt England and Holland but that there was<br />
a publique and open warre proclaimed betwixt them hee did not heare<br />
untill after the said fight. And further cannot depose.
To the 11th hee saith that when the said ship was seized shee was<br />
in her direct course for Dunquerke to which place and not elsewhither she<br />
was bound. And otherwise answereth negatively.
To teh 12th 13th and 14th he saith that the ''Advantage frigot'' are are they haled<br />
the ''morning starre'' did whilest her dutch colours were out discharge<br />
Two great Gunnes at the ''Morning Starre'' and then at her comeing to hale her<br />
and not before tooke them downe and put out the English Colours and required<br />
his precontest to strike saile (which was accordingly done) and<br />
come abord with his boate which his said precontest refused he doe<br />
partly because his boate was not fitting to goe to hher and partly because of his<br />
letting partly because of his<br />
