Transcription '''Z.Z./''' 3d of December 1653 [CENTRE H'''Z.Z./''' 3d of December 1653 [CENTRE HEADING] Price against Smith}<br /> ffrancklin Smith} '''Rp''' '''Thomas Dawes''' of Shadwell in<br /> the parish of Stepney Mariner where<br /> he hath lived five yeares, aged<br /> about 30ty yeares, a wittnes produced<br /> and sworne in this cause, and being<br /> examined deposeth as followeth. To the first article of the Libell given on and admitted in this cause he deposeth and saith<br /> that he this deponent was Masters Mate in the shipp the ''West India Merchant'' in a voyage<br /> to Virginia in the yeare 1651 arlate and that then the<br /> arlate John Price was Owners and Proprietor of an<br /> eight part of the said shipp the ''West India Merchant''<br /> And further he cannot depose. To the 2d article he cannot depose. To the third article of the said libell he deposeth and saith<br /> that the arlate John Price did goe Master of the shipp the<br /> ''West India Merchant'' in the voyage arlate and in this<br /> deponents sight and observation the cheife care of<br /> victualling and fitting out the said shipp for the<br /> sayd voyage was in the said John Price and by him<br /> performed And further he cannot depose. To the fourth article and to the schedule therein mentioned in the<br /> schedule was now shewen [?unto] and by this deponent precontest<br /> he deposeth and saith that he being Masters Mate in the<br /> voyage arlate well knoweth all the severall persons named<br /> and particularised in the said first schedule and he beleiveth<br /> they were all signed by the arlate John Price, And [?XX]<br /> sayeth that the greatest Number of the sayd persons<br /> were payd the respective summes sett downe in the<br /> said schedule in the sight of him this deponent by the<br /> sayd John Price, And that he this deponent (who is<br /> the first man named in the said schedule did receive<br /> for his wages due to him from him the arlate Price<br /> the summe of 24 [?''li''] as is sett downe in the said schedule<br /> which was due to him the deponent for 9 and 6 dayes wages<br /> in the sayd shipp the voyage arlate, And that all the<br /> said persons did serve in teh said shipp the respective<br /> times sett downe in the said schedule And further he<br /> deposeth not.
