within the Dominions of the King of Spayne or the Commonwealth of England and<br />
to depart with their sayd shipps and goods freely and quietly. And otherwise<br />
he cannot depose.
To the sixth article of the sayd allegation This deponent saith that there is a Recitall or<br />
Clause in the foresayd Commission wherein It is expressed that the sayd ffawther<br />
hath given bond of 3000 ''li''. to the Keepers of the Liberty of England by authoruty<br />
of Parliament to bring all such prizes as he should take by vertue of the<br />
sayd Commission into some Port or Harbor of this Commonwealth, and to Judgment<br />
in this Court or to that effect, which he knoweth for the reasons aforesayd and<br />
otherwise cannot depose.
To the seventh article of the sayd allegation This deponent saith that as he understood by<br />
the sayd ffawther and as he verily beleiveth the sayd ffawther if he had not bene<br />
hindred from so doeing att Ostend as aforesayd would have brought the sayd prize<br />
shipp to the Port of Dover or some other Port of this Commonwealth. And otherwise<br />
he cannot depose.
To the eighth article of the sayd allegation , This deponent saith that att the tyme of the<br />
seizure of the sayd shipp ''ffrancis'' att Osetnd as aforesayd there was and remained<br />
aboard her provisions Armes and ammunition for the use of the sayd shipp in her<br />
sayd warlike expedition to the value of 30 ''li''. sterling which he knoweth being<br />
master of her as aforesayd. And otherwise cannot depose.
To the nynth article of the sayd allegation and papers therein mentioned This deponent saith that the sayd Captaine ffawther<br />
hath by all faire and lawfull wayes in a legall manner endeavoured and<br />
Requested the restitution of the sayd shipps the ''ffrancis'' and the sayd prize<br />
shipp of and from the Judges and Officers and Ministers of Justice of the<br />
sayd Towne of Bridges and Admiralty thereof And he saith that the sayd<br />
Dutch papers to the allegation annexed and now shewne him were and are as he<br />
verily beleiveth true Copies of the Proceedings had and made in the<br />
sayd Court of the Admiralty of Bridges of and concerning the sayd<br />
shipps and restitution thereof, the ground and reason of this deponents<br />
beleife was and is for that he reeyved the sayd papers inclosed in severall<br />
letters from the freind or Correspondent of the sayd ffawther att Bridges<br />
who did sollicit the sayd busines in his behalfe, and the sayd letters (which<br />
this deponent saw opened and heard read att Ostend whither they were directed<br />
to the producent) did certify and sett forth that the foresayd papers now<br />
shewne him were the proceedings had and made att Bridges in and<br />
touching the business aforesayd. And otherwise cannot depose.
To the tenth eleaventh and twelfth articles of the sayd allegation, This deponent saith<br />
that teh foreayd shipp of 60 tonnes taken by the ''ffrancis'' as aforesayd was<br />
a shipp of fflushing belonging to the Subiects of the States of the<br />
United Provinces and would have bene and proved prize if she had bene brough to<br />
adiudication, and somuch the Master of her the sayd Berhenaer did<br />
acknowledge and confesse. and saith the sayd ffowther in seeking<br />
restitution of the sayd shipps hath expressed severall summes of money<br />
of good value, and expended in and during his sayd imprisonment the summe<br />
of 15 ''li''. or thereabouts, and himselfe, and sayd shipps ''ffrancis'' Company<br />
have otherwise suffered great dammage and losse which he is not able to<br />
value. And further cannot depose./.
