it at distance as aforesayd but was not present with his shipp in actuall fight till about an howre before the seizure.

To the .11. he saith that Many of this deponents Company and likewise<br />
of the ''Advantage frigotts'' Company entred the ''Golden Starr'' upon<br />
boarding, and were some of them likewise afterwards abord, And<br />
this deponent and Captaine Mills were likewise aboard. And saith that<br />
he this Rendent for his owne part had nnot nor tooke out of the sayd shipp<br />
any plate or moneyes or any other goods whatsoever nor somuch as an<br />
Orange or Lemmon, And saith he beleiveth some moneyes and other<br />
goods were plundered by the Mariners of the sayd frigotts, but what<br />
to what value or by whom in particular or buy name this Rendent<br />
knoweth not. And further cannot depose.
To the 12.th he referreth himselfe to the Law in that behalfe and<br />
otherwise is not bound to answer as he beleiveth.
To the 13. Interrogatory he saith that in case the ''Morning Starr'' shall be<br />
adiudged prize he this Rendent expects such benefit thereby as<br />
one serving in his quality may and ought to expect according to<br />
the Acts of Parliament in such cases provided and not more. And<br />
otherwise cannot depose.

'''Peter Caulier''' of Lothbury in the Citty of London merchant aged<br />
27 yeares or thereabouts a witnes sworne and examined deposeth and<br />
ayeth as followeth. videlicet.
To the first second and third Articles of the sayd allegation he saith he<br />
knoweth nothing thereof.
To the fourth fifth sixth seventh eighth nynth and tenth Articles of the<br />
sayd allegation, this deponent saith that about the month of July last past having<br />
seene a publicke intimation affixed upon the Exchange London concerninge<br />
the sale by the Candle of severall quantities of prize wheat, he went downe<br />
unto Lymehouse aboard the arlate shipp the ''ffortune'' of Stetin upon which<br />
some of the sayd wheat intimated to be sold by the Candle as aforesayd was<br />
laden, with intent to veiw and search into the condition thereof in order<br />
to bid moneyes for and buy the same upon the say of sale appoynted<br />
in case he found it a penny worth and fitt for his turne. And saith that<br />
being come aboard the sayd shipp he found the sayd wheat coursly sealed<br />
and so hard clotted and baked together that he could not thrust his<br />
