Transcription of the sayd cases containing two thousand of the sayd cases containing two thousand eight hundred peru peices one case<br /> excepted wherein were onely fifteene hundred Ryalls and the same was <br /> filled upp with sevrall barres of sylver weighing in the whole one hundred <br /> eighty four markes, the sayd six cases being mentioned in the fifth<br /> schedule arlate, and aboard the ''Salvador'' Christian Cloppenburgh master one <br /> Case of Ryalls of eight Peru money conteyning two thousand seven hundred <br /> and fifty peices mentioned in the second schedule arlate. And aboard the <br /> arlate shipp ''Saint George'' twelve barrs of sylver weighing sixteene <br /> and two cases or trunkes with linnen and table, plate and a bagg of <br /> moneyes contayning two hundred and and fifty peices of eight more or less<br /> all the sayd plate money and goods to be carryed transported in the sayd <br /> shipps respectively for the use accompt and Risgo of the sayd John Mexia <br /> de Herrera to be delivered att Ostend to himself or Agents for his use<br /> and Accompt And his further saith that for and during all the tyme arlate<br /> the sayd Producent was and att present is the true sole and lawfull Owner and <br /> Proprietor of the sayd money plate and Goods and for such was and is <br /> accomted and taken, the premisses this deponent knoweth to be true having <br /> seene all the sayd money plate in the quiet and peaceable possession of the<br /> producent att Limma in the West Indies where he bought and procured the<br /> same for his owne use, and seeing and knowing that he brought the same <br /> from the Indies aforesayd to Cadiz where this deponent saw the same<br /> laden aboard the sayd shipps respectively as aforesayd for the use Risco<br /> and Accompt of him the sayd John Mexia de Herrera. And further saith<br /> that he this deponent saw the sayd moneys told and counted in the West Indies<br /> and there assisted to take upp and bagged up the same, and there otherwise<br /> saw the markes and numbers of the weight of the sayd barrs and barretons<br /> whereby and by the bulke thereof he cometh to know the weight of the same. And otherwise he cannot <br /> depose, saving he saith he saw the sayd cases and barres marked but cannot <br /> sett forth the particular marks referring himselfe in that particular to the<br /> Bills of lading to the Allegation annexed and saving that producent as he hath heard came from Cadiz<br /> in the ''Saint George'' and was aboard her att this tyme of seizure By the Parliaments shipps To the third he hath saith That after the lading of the Sylver as aforesayd and on or <br /> about the thirteenth day of October as this deponent hath heard and beleiveth <br /> the sayd shipps departed from Cadiz and were seized in the downes by the shipps<br /> of the Takers as the deponent beleiveth. And further he cannot depose To the fourth he saith and deposeth that after the lading of the sayd sylver and <br /> plate as aforesayd videlicet on or about the seventh day of October 1652. he <br /> this deponent was present and saw the arlate Otto George Captain of the ''Sampson''<br /> aboard his shipp signe and firme three bills lading all of one tenor<br /> for the sayd six cases of Ryalls of eight with the sayd barretons laden aboard the ''Sampson'' as<br /> aforesayd mentioned in the said first schedule arlate, and saw likewise the arlate<br /> John Martin dorp signe firme aboard his shipp the ''Saint George'' <br /> three bills of lading all of one tenor for the sayd twelve barrs of sylver and seven Chests of <br /> barretons of sylver mentioned in the sayd third schedule arlate laden aboard the sayd <br /> shipp ''Ssint George'' as aforesayd. And further saith that after signing of the sayd<br /> Bills as aforesayd sylver eyther of the sayd Captaines had and tooke one of the sayd <br /> bills respectively keeping the same in his owne position. And further <br /> referring himself to the Acts of this Court he cannot depose.
