hands deliver the same to a Barkier att Cadiz who in this deponents<br />
sight putt the same into his barke or boat, and att his returne from the<br />
sayd shipps whither this deponent sent him to lade the same, he the sayd<br />
Barkier brought this deponent Receipts from the masters of the sayd shipps<br />
for the parcells of moneyes and plate laden aboard them respectively as aforesayd<br />
And this deponent afterwards saw the Bills of lading signed for the same<br />
which were delivered to him this deponent. And further he cannot depose.
To the 4th article of the sayd Allegation<br />
This deponent saith that about three or four dayes after the lading<br />
of the sylver plate and moneyes as aforesayd, the sayd Christian Cloppenburgh<br />
in the presence and sight of this deponent did signe and firme three vills of lading<br />
all of one tenor for the sayd two barrs of sylver laden aboard the ''Salvador''<br />
as aforesayd; and the sayd Otto George signed and firmed in the presence and<br />
sight of this deponent three bills of lading all of one tenor for the sayd two<br />
baggs of moneyes laden aboard the ''Sampson'' as aforesayd. And the sayd John<br />
Martinsdorp in the presence and sight of this deponent signed and firmed three<br />
bills of lading all of one tenor for the sayd two barrs of sylver and one bag<br />
of moneyes laden aboard the shipp ''Saint George'' as aforesayd. And he saith that<br />
three of the sayd Bills of lading videlicet one of each tenor were by this deponent<br />
left in the Custody of the sayd persons who signed the same respectively as<br />
aforesayd. And he beleiveth that the same were aboard their respective shipps<br />
att the tyme of seizure, and are since brought into this Court and abide in the<br />
Registry thereof. And further he cannot depose.
To the fifth he saith that after the lading of the sayd sylver and moneyes and<br />
firming of the sayd bills of lading severally as aforesayd he this deponent<br />
sent a letter of advise together with the sayd three bills of lading to<br />
the allegation annexed, and directed the sayd letter to be delivered to the<br />
sayd Dominick Marten att Ostend this deponent then conceyving that his<br />
sayd father was there. And this deponent hath heard by and from his contest<br />
in this cause Daniel Archer that the sayd letter of advise and bills of lading came<br />
to the hands of the sayd Dominick Martin, here in London, who did himselfe<br />
allso by letters signify to this deponent to come for London as being<br />
a necessary witnesse in this cause, and saith that att his arrivall here att<br />
London he this deponent found the sayd bills of lading annexed to the<br />
allegation in the hands of the sayd Daniel Archer being a correspondent<br />
of the sayd Dominick Martin who gave order to the arlate Samuel<br />
ffranklyn to prosecute this cause as his Proctor, as the sayd Mr ffranklin<br />
hath told this deponent. And otherwise he cannot depose
To the sixth he saith and deposeth that the sayd shipps the ''Salvador'', ''Sampson''<br />
and ''Saint George'' after the lading of the sayd sylver and moneyes departed from<br />
Cadiz towards Ostend whither they were bound, having the silver and moneyes<br />
now claymed then on board them respectively as aforesayd. And saith he hath<br />
