Transcription The 4th of January 1654/5:- [CENTRE HEADINThe 4th of January 1654/5:- [CENTRE HEADING] Captaine John Arthur against Pitt et cetera:} Examined upon the said Allegation:-/ '''Rp. 4tus''' '''John Diett''' of Limehouse in the parish of Stepney<br /> Mariner aged 50 yeares or thereabouts a Wittnes<br /> sworne and examined saith as followeth, videlicet: To the first article of the said Allegation, hee saith hee well knoweth the arlate<br /> Thomas Browne, and knew him to be Master of the shipp the ''John''<br /> arlate upon the Voyage in Controversy. And further cannot depose./ To the 11th hee saith, That the said shipp the ''John'' being laden at Porta<br /> Port in Portugall in or about the moneths of ffebruary or March <u>1653.</u> English<br /> stile and bound, (as was there reported for the Barbadoes) was of this<br /> deponents sight and observation for about 3. or 4. weekes after such her lading<br /> constrained to stay and abide there, for that shee could not passe over the barr<br /> and saith that during that time a fflemmish or hamburgher shipp having<br /> also there laden and being of a burthen much inferior to the said shipp the<br /> ''John'' yet was not able to passe the said Barr of Porta Port,<br /> The premisses hee knoweth being<br /> att the same time at Porta Port Cooper of and aboard the shipp the<br /> ''Porta Port Merchant'' then and there also taking in her lading. And<br /> further hee cannot depose./ To the 12th hee saith hee beleeveth the shipp the ''John'' arlate was and<br /> is of the burthen of one hundred tunns and upwards, and beleeveth<br /> that the same being full laden doeth draw thirteen foot water or<br /> thereabouts, and so much this deponent hath sewerall times heard from divers<br /> of the said shipps Companie. And further cannot depose/ To the 13. hee saith, That hee this examinate was never but once, in<br /> the time predeposed at Porta Port interrate, at which time the said<br /> shipp the ''Porta Port Merchant'' wherein this deponent served was piloted<br /> over the barr allate neere Porta Port by a Pilot or pilotts of and<br /> belonging to that place, And saith hee beleeveth the same is also usually<br /> to be done to and with all forraigne shipps coming to trade there, And<br /> further cannot depose./ To the 14th hee saith, That as this deponent was credibly informed at<br /> Porta Port aforesaid, it was and is there a Custome of that place<br /> that the Pilots there usually knowne by the name of the kings Pilotts<br /> are to determine when the Tyde and height of water is convenient<br /> for all sorts of shipps to passe with securitie over the said barre, and that<br /> they have a salary or allowance for the same out of each shipp so<br /> passing, and are for the preservation of their Creditt and livelihood<br /> observed to bee very carefull in that their undertakeing: And further cannot depose (To theakeing: And further cannot depose (To the  +
