Transcription to the Port of London, in which hee was anto the Port of London, in which hee was and served during the time<br /> the said shipp ''John'' tooke in her lading as aforeasid, and saw and observed<br /> the lading and departure of the said shipp, and her bulke and burthen<br /> And further cannot depose./ To the 13. and 14th articles of the said Allegation hee saith and deposeth, That,<br /> hee this deponent hath been onely once at Porto Port allate and that in<br /> the quality predeposed, and saith that neere unto the harbour of that place<br /> there was and is a very dangerous barr, over which the shipp the Porta<br /> Port Merchant aforesaid was pylotted by the king of Portugalls<br /> pilotts belonging to that harbour both in her coming in and goeing out<br /> And saith, That (as this deponent was then credibly informed and by his<br /> particular observation is assured) no forraigne shipps doe use to passe<br /> the said barr without the Conduct of such Pilot or Pilots, who doe<br /> usually judge of the convenience of tide and water sufficient for the<br /> passing of shipps according to their severall burthens and conditions, and<br /> who are, (as haveing their livelihood thereupon depending) very carefull<br /> and circumspect in the conducting of shipps over the said barr, which they<br /> doe nt nor will attempt but at such seasons as the height of water<br /> is sufficient for such their passage. And further cannot depose./ To the 15th article of the said Allegation hee saith and deposeth, That upon or<br /> about the last day of Aprill last past the said shipp the ''John'' in this<br /> deponents sight passed the said barr of Porta Port togeather with two other<br /> shipps, shee ghaveing then remained there for about 3. or 4. weekes (as this<br /> deponent now remembreth the time) attending a convenient season to passe<br /> with security over the said barr. And otherwise saving his precedent and<br /> subsequent depositions hee saith hee cannot depose./ To the 16th hee saith, That in and by the time aforesaid there was at<br /> Porto Port aforesaid a hamburgher or fflemish shipp laden with<br /> Oranges, lemmons, shomack and other Commodities, which shipp to the best<br /> of this deponents judgement and estimation being fully laden did draw about 10<br /> ort 11. foot water, and saith that the said shipp being so laden went towards<br /> the barr of Porta Port aforesaid, (about 4. or 5. dayes before the ''John''<br /> descended thither) designed as this deponent was then credibly informed to<br /> passe the said barr, but findeing no conveniemt season so to doe, and the fruit<br /> on board her being in a very perishable condition, the Master and Company thereof<br /> were constrained by reason of their necessitated stay to throw much of the said<br /> fruit overboard, this deponent seeing and observing the said fruit floating<br /> upon the water, And saith That this deponent saw the said shipp ''John''<br /> and the flemmish or hamburgher Vessell aforesaid passe the said<br /> barr togeather upon or about the last day of Aprill<br /> last past/.
