guilders a day for every day that the sayd vessell should be stayed above the sayd<br />
thirty dayes in receiaving in and delivery out of her sayd ladeing, And hee alsoe saith<br />
that hee well knoweth being Master as aforesayd that the sayd Vessell the ''Elizabeth''<br />
of fflushing did notwithstanding the sayd agreement lye and was deteyned by the<br />
sayd ffreighters at Bayon aforesayd for the receaving in of the sayd goods on<br />
board her from the 25th day of August last past to the 28th day of September<br />
last soe that the whole tyme agreed upon betweene the sayd ffreighters<br />
and this deponent for ladeing and unladeing the sayd vessell as aforesayd was expired<br />
and spent before hee this deponent came from Bayon with the sayd vessell and<br />
goods And hee further saith the sayd vessell after her comeing from Bayon<br />
aforesayd was with her ladeing aforesayd surprized and taken by the ''Tyger''<br />
''ffrigott'' in the imediate service of this Commonwealth and by the Commander thereof<br />
brought up to this Port of London where shee hath bin deteyned wver since the<br />
7th of October last untill the wighth day of this instant december on which<br />
day and not before this deponents aith the Commissioners of this Commonwealth<br />
for prize goods did pay unto this deponent the freight due to him this deponent<br />
for all the goods seized in the sayd vessell soe that before that tyme hee<br />
this deponent could not goe away with the sayd shipp ''Elizabeth'' but was thereby<br />
constretned to lye at this port of London forty and two dayes before the sayd goods<br />
were unladen and taken out of the sayd shipp and wayters belonging<br />
to the sayd Commissioners continued aboard the sayd shipp during the sayd<br />
two and forty dayes and hee this deponent did pay the sayd Commissioners for<br />
prize goods for their wayetrs attendance during the sayd 42 dayes And further<br />
hee cannot depose saving hee saith that as hee verily beleeveth and in his this<br />
deponents Judgment this Commonwealth of England doe in this case succeede<br />
in the place and [?stead] of the freighters allegate and ought as hee this<br />
deponent beleeveth to pay all manner of payments which the sayd ffreighters<br />
did contracte for and give to pay./
To the Interrogatories. [CENTRE HEADING]
To the first Interogatorie hee saith hee is promised nothing by Evert Gislin Interrogate<br />
nor any other of the Owners of the shipp ''Elizabeth'' in case the demorage Interrogated<br />
bee adiudged to them nor expecteth any benefitt thereby only what wages shall<br />
become due to him for the tyme hee hath bin deteyned longer then the agreement<br />
made betweene the Owners and this rendent./
To the second Interrogated hee saith the ''Elizabeth'' Interrogate began to deliver her goods<br />
which were seized on board her to the Officers for prize goods appointed to receave the same<br />
about the 10th day of November last and the sayd shipp was [?cleerely] unladen by the<br />
sixteenth day of the saud moneth as hee beleeveth and otherwise saving his foregoeing deposition<br />
hee cannot answere./
To the third Interrogatorie hee cannot answere not knowing the date of the decree<br />
Interrogate nor the date of the order of the Commissioners Interrogated thereupon<br />
