Transcription plaintiff againt John Brewer defendant, upplaintiff againt John Brewer defendant, upon the triall whereof<br /> the foresaid Statute being produced to the Judge and Jury upon<br /> the question whether the Tonne of oile should containe<br /> 236 or 252 gallons, the Judge and Jury found that it ought<br /> to containe 252 gallons, and the Jury gave their verdict [?XXX]<br /> and not otherwise, and otherwise hee cannot depose, saving<br /> hee knoweth the premisses being attorney for the defendant [?at ?Triall] To the Interrogatories. [CENTRE HEADING] To the first hee saith hee is an attorney at law, and<br /> otherwise negatively To the second hee saith hee was not present nor knoweth<br /> ought of the matters interrogated. '''4us,''' '''John Seede''' of the parish of Saint Mary Woochurch<br /> London Citizen and haberdasher of London, aged<br /> 55 yeares or thereabouts, sworne and examined. To the first hee saith that according to a Statute of this land<br /> 252 gallons and noe lesse of sweete oiles doe make a tonne,<br /> and otherwise referring himselfe to the lawes and to the said Statute<br /> hee saith hee cannot depose To the second hee saith hee is an oile man by trade, and<br /> within the time arlate hath bought diverse parcells of sweete<br /> oiles in this citie and elswhere in this Nation at 252 gallons<br /> the tonne, and noe lesse, And otherwise hee cannot depose. To the third hee saith that in case any man buyes sweete oiles<br /> by the tonne, without mention of howe many gallons are to goe to<br /> the tonne, the said Statute will allowe and give him (as hee [?conceiveth])<br /> 252 gallons to the tonne, And otherwise referring himselfe to<br /> the said Statute hee cannot depose. To the fourth hee saith that in July last there was a triall at<br /> Guildhall (whereat this deponent was present) betweene Peter<br /> Thoroghgood plaintiff and John Brewer defendant about the gage<br /> of oiles bought and sold betweene them, and there was a verdict<br /> given upon the said [?statute] against the said Brewer for 252 gallons<br /> to the tonne, And otherwise hee cannot depose. To the 5th hee saith that the usuall gage of sweete oiles by the<br /> gage is 252 gallons to the tonne, and the citie gager doth usually<br /> gage at that rate, being sworne thereto.
