[CENTRE HEADING] The Clayme of Peter Ceely Esquire for the shipp the}<br /> ''Peter'' of Saint Ives and her tackle and furniture seized}<br /> upon the Port of Pensance in Cornewall Smith} Examined upon an Allegation on the behalfe of<br /> the said Peter Ceely./ '''Smith dt.''' '''jus''' '''John Purefoy''' of Saint Ives in Cornwall Merchant<br /> aged 23. yeares or thereabouts a Wittnes sworne and<br /> examined./: To the first article of the said Allegation hee saith and deposeth, That hee<br /> well knoweth the Vessell the ''Pieter'' arlate, and hath so knowne her for<br /> about 18. moneths last ast, during which time the arlate Peter Ceely, and<br /> Alexander Penhellick of holston in Cornewall were and at present ought<br /> to bee the true and lawfull Owners and Proprietors of the said Vessell and<br /> of her tackle apparrell and furniture, and for such were and are well<br /> knowne in those parts of Cornewall, and saith That in or about the<br /> moneth of June or July last past, the said Peter Ceely and Alexander<br /> Penhellic sett out the said Vessell laden with Coales and fish from the<br /> Port of Saint Ives in Cornewall bound for ffrance, The premisses hee declareth and<br /> deposeth, for that hee this deponent being an inhabitant of Saint Ives, and having<br /> intimate acquaintance with the said Owners and having been sewerall times aboard<br /> the said Vessell in that port, and hath thereby taken notice, and hath certaine<br /> and assured knoweledge of the Proprietie and Voiage aforesaid; And<br /> saith, That the said Vessell (as this deponent by the credible relation of<br /> her Master and Companie hath understood) was in her said intended<br /> Voiage for ffrance intercepted and taken by a Pirate of Brest, whereof one<br /> Captaine Smith was Commander And further cannot depose./ To the second hee saith, That in or about the moneths of August or<br /> September last past, the said shipp or Vessell the ''Peter'' returning<br /> from Brest laden with Salt, and arriving at Pensance in Cornewall<br /> the said Peter Ceely caused the same to be arrested, as this deponent since<br /> understood by an Admiraltie warrant, And saith that hee this deponent<br /> both before the said Vessell sett saile from Saint Ives, and after her returne to Pensance<br /> as aforesaid hath sewerall times been aboard her at Saint Ives, and since her<br /> returne from ffrance seene her at the said port of Saint Ives, and hath taken<br /> very exact and particular notice of her, and both by his owne observation, and<br /> by the Confession of her Master and Companie who went and came in the same<br /> Vessell to and from france, well knoweth the said Vessell is arrested to be<br /> one and the same Vessell which did and doeth of right appertaine to the<br /> Proprietors aforesaid. And further to this article hee cannot depose./ To the third hee saith, That hee very well knoweth the arlate Peter<br /> Ceely, and the said Alexander Penhellick to be subjects of this<br /> Commonwealth, and well affected to the Government thereof, this deponent<br /> being a person familiarly acquainted with them.
