To the first article hee saith and deposeth that the shipp the<br />
''Saint John Baptist'' articulated, at the time of her seizure was (as to this<br />
deponent appeared by her molde and fashion) a dutch built shipp; and<br />
saith the shipp the ''hope'' (whereof this deponent was the Captaines cheife<br />
mate) one of the shipps of the fleete of this Commonwealth upon<br />
that expedition (whereof Major Sedgewick was commander in cheife)<br />
came up with the said shipp the ''Saint John Baptist'' on the one side as<br />
the ''Black Raven'' (another of the shipps of the said fleete) come up<br />
with her on the other, and alsoe haled her, and upon such haling,<br />
the company of the ''Saint John Baptist'' being demannded, whence their<br />
shipp was, this deponent heard them answer and say, of Amsterdam.<br />
And otherwise hee cannot depose.
To the second and third hee cannot depose, for hee was not present<br />
at the Counsell of Warr arlate, nor knoweth what passed therein<br />
only hee saith that Captaine Martin commander of the ''hope''<br />
who was at the said Counsell of warr, retourneing aboard, declared<br />
to this deponent and others of his company, that the master and<br />
company of the ''Saint John Baptist'', albeit that they had said at the<br />
time of their haling, that they were of Amsterdam, yet upon their<br />
further examination at the said Counsell, they (perceiving that they<br />
were falne into the hands of the English) denied their being of Amsterdam,<br />
and had sais that they were of dantzike and were bound for London;<br />
or to the same effect, and yet (as hee said) they could not<br />
produce ought to [?evidense] their being bound for London.
To the fourth hee saith that the lading of the said shipp the ''Saint''<br />
''John Baptist'' consisted cheifely in wines, and the rest in<br />
resin and feathers and some other things, and saith the said wines<br />
and goods come from Bayon (as the said company of the ''Saint''<br />
''John Baptist'' acknowledged) and were as hee verily beleeveth of the<br />
producetion or make of ffrance And otherwise hee cannot depose.
To the fifth hee saith that the said shipp ''Saint John Baptist'' was<br />
taken and seized in or about the moneth of March 1653, And<br />
otherwise referring himselfe to the articles of pease arlate and the<br />
date thereof hee cannot depose.
To the 6th hee saith that the company of the ''Saint John Baptist'' at<br />
the time of the said seizure were all forreigners and strangers<br />
save one boy who was English. And otherwise hee cannot depose.
To the seaventh and eighth hee referreth himselfe to the lawe<br />
and to the customes and usage in the case articulate, And<br />
cannot otherwise depose saving as aforesaid.
