To the first article of the sayd Libell he deposeth and<br />
saith That he very well knoweth the shipp arlate<br />
sometimes called the ''ffortune of the Sea'' and now called<br />
the ''Post'', and that the arlate Philip Richaut and<br />
Company were in the months arlate videlicet in the months<br />
of November, December, January and ffebruary<br />
1653 English stile and alsoe before and at theis present<br />
are and ought to be (as he beleiveth) the lawfull Owners<br />
and Proprietors of the sayd shipp and her tackle apparrell and furniture The premisses he<br />
deposeth for that he was furing all the arlated<br />
monthes Master of her, and did a good while before that<br />
namely in the yeares 1651 buy the sayd shipp for the<br />
account of the sayd Philip Richaut and Company<br />
At Ostend And further he cannot depose.
To the 2d article he deposeth and saith That in the month<br />
of ffebruary 1653 arlate the sayd shipp then called the<br />
''ffortune of the Sea'' and now the ''Post'', was sett out<br />
and imployed upon a voyage from this Port of<br />
London to Roane in ffrance by and for the<br />
account of the arlate Philip Richaut and Company<br />
the Owners of her and that the said shipp did of<br />
this deponents knowledge (being then Master of her)<br />
arrive in the said month of ffebruary 1653 at Roane<br />
in ffrance in safety for the use and account of the Owners<br />
arlate And further he cannot depose.
To the third and fourth articles of the sayd Libell he deposeth<br />
and saith that the said shipp being soe safely arrived at<br />
Roane for the use and account of the arlate Philip<br />
Richaut and Company, she was in the said month of<br />
ffebruary 1652 arlate seized upon by some ffrenchmen<br />
and by them detayned from the sayd Richaut and<br />
Company the Owners of her, and that he this deponent<br />
being then Master of her, and putt in by them the<br />
sayd Richaut and Company the sayd Owners of her was<br />
turned out of possession of her, And he further<br />
deposeth that the said shipp doth at this rpresent lye<br />
in the River of Thames, The which he well knoweth for<br />
that he was on board her on this very day in Saint Katherins Dock and that the<br />
sayd shipp sometimes called the ''ffortune'' now the ''Post'', which lyeth<br />
under arrest out of this Court at the suite of the<br />
arlate Richaut and Company) is the very same shipp<br />
that he this deponent went Master of to Roane for the<br />
account of the arlate Richaut and Company the Owners<br />
of her and was there seized on as aforesaid, And further he cannot depose.
To the fifth article he saith that the arlate shipp was<br />
arrested (as he beleiveth) by vertue of a warrant out of<br />
this Court, And further referring himselfe to the<br />
REgistry of thos Court he cannot depose.
To the last he saith his deposition is true./
