Transcription in the way of merchandize both with the sain the way of merchandize both with the said John and the said Peter<br /> well knoweth that they the producents are traders in partnershipp<br /> and saith hee hath received goods from and sent goods to them upon their<br /> ioynt accompt as partners in trade, and severall times this deponent<br /> by order of the said John Taviell hath sent goods and merchandizes<br /> from this [?port] to Porto to the said Ayrall upon the said ioynt<br /> accompt. And otherwise hee cannot depose. To the second article hee saith that in or about the moneth of May<br /> last the said Peter Ayrall at Porto aforesaid laded three chests<br /> of sugar of the marke in the margin aboard the said shipp thE ''Orange''<br /> ''tree'' for the accompt of him and the said John Taviell to be caried in the '''EVR''' [MERCHANT'S MARKE, LH MARGIN] said shipp to Roane and there to be delivered to Beniamin Benzelin<br /> their factor or correspondent for their use, which hee knoweth having<br /> received letters of advise and the factory for the said sugars from the<br /> said Taviell to the same effect. And otherwise cannot depose. To the third article hee saith that this deponent hath alsoe bin advised<br /> by letters from the said Taviell, that whereas the consignement of the<br /> said three chests of sugar was made to the arlate Abraham Pelt Phillips to<br /> Amsterdam, and as for his accompt, such consignement<br /> was mearly colourable and to preserve the said goods from seizure<br /> by the enemies arlate, and that the bill of lading and letter of consignement<br /> to that purpose, were mearely pro forma, and to avoide seizure,<br /> but in truth they were belonging to him and the said Ayrall, and were<br /> consigned truely to Beniamin Benzolin for their accompt. And saith the<br /> said Phillips is alsoe a factor or correspondent of the said Taviell and<br /> Ayrall; and they were and are all in amitie with this Commonwealth.<br /> And otherwise hee cannot depose. To the fourth hee saith that this deponent in the moneth of June last<br /> received letters from the said Taviell to the effect arlate and therewith<br /> the foresaid factory which hee nowe bringeth and leaveth, and gave him<br /> this deponent intelligence that there was a letter and bill of lading to<br /> Abraham Pelt Phillips pro forma, and desired this deponent tO<br /> looke after the recovery of the said sugars for thm the said Taviell and<br /> Ayrall, And saith he said Taviell is a merchant of very good account<br /> and qualitie at Lile, and for such commonly accompted. And otherwise<br /> hee cannot depose. To the Interrogatories. [CENTRE HEADING] To the first hee saith hee is an English man borne at Canterbury<br /> and otherwise negatively saving as aforesaid. To the second and 3 negatively for his part, and otherwise hee cannot depose<br /> saving as aforesaid. To the 4th negatively, saying hee verily beleeveth the said sugars to be really<br /> belonging to the said claimers. To the 5th hee beleevth the said Beniamin Benzelin to be a ffrench man<br /> and to have lived severall yeares in Roane, but saith hee doth not knowe [?him]<br /> And otherwise hee cannot depose. To the 6 and 7 hee cannot depose. To the 8 hee saith hee sent 2 bales of clothes for Porto to the said Ayrall by order<br /> of the said Taviell, the 28 June 1654 in the ''James'' of London Richard [?Griffin]<br /> master, and 26 ffebruary last. by the shipp ''Valenttine'' Robert B[?auch] master<br /> 4 bales of bayes clothes; And this deponent hath by order of the said [?Taviell]onent hath by order of the said [?Taviell]  +
