thereof doe or doth belonge to some ffrenchman or ffrenchmen, subiects of<br />
the ffrench king.
To the fourth hee saith the said shipp comming out of ffrance<br />
as aforesaid, had neither passeport nor cocket that this deponent<br />
knoweth of, And otherwise hee cannot answer.
To the fifth hee saith that upon the said seizure this deponent having<br />
speech with Captaine Saunders, told him (as hee remembreth) that hee this<br />
deponent had two thousand pounds adventure in the said shipp the<br />
''hare'', and that the said Captaine asking him for his bills of lading, this<br />
deponent answered him that hee had sent the two (which hee had signed by<br />
the said master) over land, and meant to have had others of the master to<br />
the same effect, or words to that purpose, and this deponent<br />
further told him that it would be a greate hinderance to him this deponent<br />
to have the voyage soe interrupted, but that hee told him that hee<br />
had undonne this deponent and his masters, hee saith hee doth neither<br />
remember nor beleeve, And otherwise hee cannot depose.
To the 6th and seaventh and the English bill of lading<br />
interrogated nowe showne unto him, hee saith that the writing in the<br />
said bill is this deponents handwriting, and the bill of his filling<br />
up, and saith the same was soe written and filled up ashore at New<br />
haven on the said day of the said shipps setting saile thence and before shee weighed anchor, and was not<br />
written at sea nor after her setting saile from haver de Grace, And<br />
saith that after the said seizure, the sais bill of lading was showed unto this<br />
deponent by the Captaine (as hee remembreth) of the ''drake'' or ''dragon''<br />
frigot, and saith the said Captaine asked him this deponent why hee<br />
told him that hee had noe bill of lading, and whie that bill of<br />
lading was not signed or to that effect; and this deponent made him<br />
answer that hee had given it to the Purser of the shipp and soe had<br />
forgot it, or to that effect, and that hee meant to have at sea an<br />
acknowledgement in writing from the said Captaine for his said goods<br />
in generall, or els another bill of lading, but hee denieth that hee answered<br />
that the shipp was taken or chased when or whiles they were making<br />
of bills of lading. And otherwise hee saith hee cannot depose.
To the eighth Interrogatorie hee saith hee did not say to the said<br />
Captaine or other that they would have made new bills of lading if<br />
they had had moretime, but could not because the shipp was taken<br />
soe soone after her comming out, but said hee ment as aforesaid to<br />
have an acknowledgement or another bill of lading from the master<br />
for his this deponents said goods as hee hath predeposed, and that<br />
hee doth not remember that the said Captaine spake to him as is<br />
interrogated, and hee saith and protesteth upon his salvation that<br />
the master and hee had not mentioned or agreed together to make<br />
more bills of lading after their comming out from their said last port<br />
saving the acknowledgement or bill of lading which this deponent intended<br />
to have for his said goods as aforesaid, neither was there any contrivance<br />
betweene them about that acknowledgement or bill, but it was this deponents<br />
purpose to goe and have it.
