by the Pylott which the sayd master tooke on board at Bilboa to pylott<br />
the sayd shipp and who did pylott her safe over the sayd barr And hee alsoe saith that hee this<br />
deponent well knoweth that presently after the sayd shipp and goods were<br />
safe come to an Anchor ober the sayd barr the sayd William Mayer<br />
the master did write a letter to the arlate [?XXXay] Westcombe the ffactor of the sayd Pitt and Marshall<br />
to give him notice of the sayd shipp and goods their arrivall and sent the same by a Spaniard<br />
to be delivered to the sayd Westcombe soe soone as possibly hee could, And<br />
further hee cannot depose saving hee saith that what ever shipp comes ober<br />
the barr aforesayd must of necessitie Come under Comand of<br />
the Castle of Bilboa and is inavoidably lyable to be searched by the<br />
King of Spaines officers there soe sooe as the officers please, and to<br />
have ridden without the sayd barr (in such tempetious weather as<br />
then was) was in the Judgment of this deponent and others as is predeposed<br />
alltogeather impossible without great perill and hazard of the sayd shipp<br />
her ladeing and Companyes lives./
To the 8th 9th and 10th articles hee saith that for the reasons in his foregoeing deposition<br />
expressed this deponent well knoweth that the sayd Mayer the master<br />
of the sayd shipp was not by reason of any neglect or fault of<br />
him or his company any cause that the goods controverted were seized<br />
by the King of Spaines officers after the sayd shipp her coming over the Barre of Bilboa<br />
for that hee this deponent well knoweth that the weather was as is predeposed<br />
soe fowle and tempetious that the sayd ship could not ride in safety without<br />
the sayd barr, neither was it in the power of the sayd Master (being come<br />
over the barr to avoide the danger of the tempest) to hinder the King of<br />
Spaines officers from comming aboard and searching the sayd shipp which they did the same day the sayd shipp came to Anchor over the barr but<br />
hee this deponent saith the true cause of the seizure of the sayd goods was for<br />
that the sayd Pitt and Marshall or their factors had not procured a<br />
licence for the safe importing of the sayd Contrabanda goods before<br />
the arrivall of the sayd shipp and goods at Bilboa And saith that for want<br />
of the sayd licence and for noe other cause the sayd<br />
Kings officers did the same day seize the sayd goods as Contranbanda<br />
goods and carried some of them on shoare and was and is<br />
a thinge publique and well knowne at Bilboa among Merchants and sea men<br />
there And hee further saith that about three weekes after the seizure of<br />
the sayd goods the sayd Kings Officers came againe aboard the sayd<br />
ship the ''Guift'' (the master thereof being then on shoare about his necessary<br />
occasions) and searched the sayd shipp againe and upon search thereof found<br />
therein moneys (belonging to the company of the sayd shipp) hadd therein,<br />
amounting (togeather with moneys found in the packetts and chests of the saud shipps<br />
Company) to one hundred and fifty dollers or peeces of eight or thereabouts<br />
part whereof the sayd Company had receaved of the ffactor or ffactors of<br />
the sayd Pitt and Marshall for wages due to them for their service in [?that]<br />
