Transcription To the last hee saith his foregoeing deposTo the last hee saith his foregoeing deposition is true/ Repeated with his precontest before doctor<br /> Clarke./ John Goodman [SIGNATURE, RH SIDE] ********************************* The 28 of July 1655./ [CENTRE HEADING] James Cowes of London Merchant against}<br /> the vessel the ''John and Elizabeth'' of}<br /> which Edward Keene is Master and}<br /> against the sayd Edward Keene Suckley}<br /> Smith} Examined upon an allegation given<br /> in on the behalf of the sayd Cowse<br /> the 31th of May 1655/ '''Rp 4''' '''Thomas Shirley''' of Saint Katherines precinct neere<br /> the Tower of London Mariner late Master of the ''Olive''<br /> ''Branche'' aged 47 yeares or thereabouts a witness<br /> sworne and examined saith and deposeth as<br /> followeth videlicet./ To the first article of the sayd allegation hee saith that hee this<br /> deponent being Master and Commander of a ship called the ''Olive Branch''<br /> and lyeing therewith at Saint Lucar during the moneths of December<br /> January and a great part of ffebruary 1654 did thereby well see<br /> and observe that the arlate Edward Keene in and during the sayd<br /> tyme had and tooke upon him the care charge and government of the arlate ship the ''John''<br /> ''and Elizabeth'' and was Commonly reputed to be Master and alsoe<br /> Part Owner of her, and hee this deponent hath heard the sayd Keene<br /> saye and acknowledge him selfe soe to be and further to this article hee<br /> cannot depose./ To the 2: 3 and 4th articles of the sayd allegation and the two schedules therein<br /> mentioned hee saith and deposeth that hee hath heard the sayd Keenes Mate<br /> and alsoe the sayd Keene him selfe while hee was at Saint Lucar the moneths of<br /> December January and ffebruary 1654 saye and acknowledge that the voyage<br /> which hee was then bound upon was from London to Santa Cruz in the Island<br /> of Palma one of the Canarie Islands, where hee was to unlade his sayd<br /> shipps ladeing and take in other goods and returne therewith for London or to that effect And saith<br /> that hee this deponent at his coming into Saint Lucar<br /> in the moneth of December 1654 with his ship the ''Olive Branch'' found<br /> the sayd Keene and his ship or Catch the ''John and Elizabeth'' in the harbour of Saint Lucar<br /> where after this deponents coming the sayd Keene did unlade his<br /> goods brought from London And further to these articles saving his subsequent<br /> deposition hee cannot depose for that hee this deponent is noe witness to the Charter<br /> party nor heard any conference which passed betwixt the sayd Keene and<br /> any of the Correspondents of the arlate Mr Cowse to the effect arlate/ To the 5th article of the sayd allegation hee saith that hee this deponent at<br /> his that hee this deponent at<br /> his  +
