of the shipp or vessell the ''Successe'' aged 36 yeares or thereabouts<br />
a witnes sworne and examined saith and deposeth as followeth videlicet
To the first and second articles of the sayd allegation hee saith that during all<br />
the moneths of June July and August last 1654 and longe before the arlate<br />
Michaell de haze and Abraham Stock were commonly accompted the true and lawfull<br />
owners and Proprietors of the vessell the ''Successe'' and her tackle apparrell and furniture<br />
and this hee beleeveth and indeede knoweth for that the sayd de haze and Stock did<br />
constitute and make this deponent Master of her for the voyage in question, and alsoe<br />
for that this deponent by the appointment and order of the sayd de haze and Stock<br />
did goe Master of the sayd vessell in ffebruary last past on a voyage from dover to Rochell<br />
and at his returne did make his Accompt to the sayd de haze and Stock and noe<br />
others as his true and lawfull Owners of the sayd vessell And further saith that hee<br />
well knoweth that about the latter end of July last the sayd vessell the ''Successe''<br />
arrived at Newcastle upon Tyne and there continued untill the 4th of August last<br />
in which tyme shee tooke in her ladeing there which constituted of Seacoals<br />
laden for the proper Accompt of the sayd de haze and Stock And hee knoweth<br />
them to bee the true Owners of the sayd Coales for that hee did by their order<br />
receive of one Mr Nicholls of Newcastle their factor or Agent there, money<br />
to pay for the sayd Coales, and such other money as hee this deponent stoode neede<br />
of for his necessary use in the sayd voyage, and hee this deponent with the sayd<br />
money did accordingly pay for the sayd ladeing of Coales And further saving<br />
his subsequent deposition hee cannot depose./
To the third 4th and 5th articles of the sayd allegation hee saith and deposeth that the<br />
sayd vessell the ''Successe'' being fully laden, and on the sayd 4th day of August cleered<br />
at the Custome house at Newcastle of all payments there due hee this deponent and company<br />
did set sayle in her with her sayd ladeing on board on the sixth day of August last<br />
intending to goe for the Port of dover but in their course thitherward as a place<br />
called the well the sayd vessell the ''Successe'' being then in about 11 fathom water and the<br />
winde blowing a prettie stiff gale South or south and by East about two of the clock<br />
in the morning of the eighth day of August this deponent and others of his Company<br />
being upon the deck of the vessell the ''Successe'' this deponent espied a vessell or shipp<br />
(which afterwards proved to be the vessell the ''dove'' in this cause complayned of)<br />
comming before the winde and steering her course directly upon the broadside of<br />
the ''Successe'' And this deponent and others of his Company then on deck seeing her<br />
the shipp ''dove'' come soe desperately toward them cried out unto the Company<br />
of the ''dove'' and desyred them to goe cleere of the vessell ''Successe'' which<br />
they might easily have done of they had pleased but the sayd Company of the<br />
''dove'' made noe answere but came still right on upon the ''Successee'' which<br />
this deponent and company seeing put the helme of their vessell ''Successe'' a Lea<br />
and did their utmost endeavour to stay her and have preserved her and them selves<br />
from the sayd vessell the ''Dove'', but the sayd vessell the ''dove'' and her company<br />
still made noe anchor but held on their course as before and carelessly or<br />
willfullyre and carelessly or<br />
