Transcription therefore God defend that hee should wrongtherefore God defend that hee should wrong him the sayd Barker or<br /> he the sayd Travers then spake words to the like effect, soe that by the<br /> sayd Account<br /> (the originall whereof doth still doth remayne in this deponents hands and<br /> Custody and which hee is ready to produce it hee shall be by this<br /> Court required soe to doe) it doe appeare (that the sayd<br /> Travers (being allowed according to his desyre the sayd summe of<br /> 482 ''li'' - 10 ''s'' - 8 ''d'' for the sayd Quarter part of the sayd Cargo of<br /> tobaccoe) was beside the same owing and indebted to the sayd<br /> Robert Barker in the summe of sixe hundred seaventy eight<br /> pounds one shilling nyne pence And further to this article<br /> hee cannot depose. To the last he saith his foregoeing deposition is true To the Interrogatories [CENTRE HEADING] To the first hee saith hee is uncle by the father side to the producent and saith<br /> hee favoureth both the parties litigant alike and desyreth right may take place in this cause<br /> and further to this Interrogatorie hee cannot answere/ To the 2 having his foregoing deposition hee cannot more fully answere to this<br /> Interrogatorie not being privie to the ladeing and setting forth of the sayd shipp/ To the 3 hee saith saving his foregoeing deposition to which hee<br /> referreth hee cannot more fully answere to this Interrogatorie/ To the 4th Interrogatorie hee saith that there was an Accompt drawne<br /> up by this deponent and the sayd Travers Barker and<br /> harvie in manner predeposed by which it did appeare as is predeposed<br /> that the sayd Travers (being allowed according to his desyre the sayd summe<br /> of 482 ''li'' - 10 ''s'' - 8 ''d'' for the quarter part of the sayd Cargoe of tobaccoe)<br /> was beside the same indebted to the sayde Robert Barker deceased,<br /> in the summe of sixe hundred seaventy eight pounds<br /> sixe shillings nyne pence And further to this Interrogatorie hee cannot depose/ To the 5th Interrogatorie hee saith hee cannot answere to this Interrogatorie<br /> otherwise than negatively well knowing that hee this deponent and<br /> the sayd Barker Travis (sic) and harvie did perfect the Accounts betweene<br /> the sayd Barker and Travis (sic) in the sayd Barkers life tyme, and brought<br /> the same to a full periodd all but the summing up thereof. and found<br /> thereby that the sayd Travers was indebted to the sayd Barker<br /> the sayd sume of sixe hundred seaventy eight pounds<br /> one shilling nyne pence./ Repeated in court the xxth of June before<br /> both Judges William Barker [SIGNATURE, RH SIDE]udges William Barker [SIGNATURE, RH SIDE]  +
