Transcription moneth of January last was a twelve monethmoneth of January last was a twelve moneth the állegate Thomas<br /> Cox (who went hence in the shipp the ''Sampson'' allegate) did at the<br /> Barbada's voluntarily forsake her and desert his service in her and<br /> went away from her against the good will and liking of John Norbrooke<br /> her master, and never retourned to his service in her againe, and<br /> saith the said Norbrooke was thereby necessitated to hire another man<br /> in the place and stead of the said Cox, all which hee knoweth because<br /> hee this deponent was masters mate of the said shipp ''Sampson''<br /> and saw such was acquainted and tooke notice of such going away<br /> and never retourning of the said Cox, but was told by the that the said Cox upon deserting the said<br /> shipp ''Sampson'', came aboard the said frigot and presented his<br /> service to the Captainee thereof and was intertained, And otherwise<br /> hee cannot depose. To the Interrogatories. [CENTRE HEADING] To the first hee favoureth the parties indifferently in respect<br /> of the trueth, and accordingly would give the victory, and otherwise<br /> negatively saving as aforesaid. To the second hee saith that the said Cox the said voyage before such<br /> his going away, did (for ought this deponent observed to the contrary)<br /> behave himselfe well and performed his place and duty in the said<br /> shipp, And otherwise hee cannot answer: To the third hee saith that the next day after the said Cox had bin<br /> and proffered his sevice to the Captaine of the ''Marston Moore'' as<br /> aforesaid, the said Lieutenant came aboard the ''Sampson'' and demanded him and<br /> tooke away him away and his clothes, and then declared that the said<br /> Cox had bin aboard the said frigot the say before and proffered his<br /> service as aforesaid, and that otherwise hee would not come fetch<br /> him, for as hee said they pressed none, nor received any but what<br /> came voluntarily. And otherwise hee cannot answer. To the fourth hee saith that the said frigot was in the service of<br /> this Commonwealth, and otherwise hee cannot answer saving<br /> as aforesaid. To the fifth hee saith that hee cannot answer saving as aforesaid<br /> and saving the company paid x s per man for damage of sugars<br /> that were leaked out, and the said Cox should have paid accordingly<br /> if hee had staid.
