a wittnesse sworne and examined saith and deposeth<br />
as followeth/
To the 1: 2: 3: 4th and 5th articles of the sayd allegation hee saith that<br />
hee this deponent was one of the Company of the arlate shipp the<br />
''Gilbert'' the whole voyage in question and thereby knoweth that while<br />
shee remayned at the Barbados the sayd voyage and after shee had<br />
taken in her full ladeing there the sayd arlate Beniamin Bellinger<br />
sent eight hogsheads of sugar marked as in the margent to be<br />
transported in her thence to England and the same being come to the<br />
shipp side it laye there two dayes or thereabouts for that the arlate<br />
William Croford and Company did refuse to take it aboard by reason<br />
they knewe their shipp to be full laden and the hold full and the hatches<br />
layed and the shipp soe full that they were forcedd to<br />
stowe some sugars and other goods betweene decks and to stowe their<br />
water and other provisions and some fustick betweene decks And saith that after the<br />
same had soe layne by the shipps side about two dayes the sayd<br />
Beniamin B[?o]llinger came him selfe aboard and spake to the sayd<br />
shipps Company and asked them why his sayd eight hogsheads of<br />
sugar were not taken aboard and this dependent and divers others of the<br />
shipps Company answered and told him that there was noe roome<br />
in the shipp conveniently to stowe them and therefore they could not take them in<br />
whereupon the sayd Bellinger desyred to speake with their Captaine<br />
the sayd Croford who was called and being come the sayd Bollinger<br />
desyred the sayd Croford that his sayd eight hogsheads of sugar<br />
might bee taken aboard and carried for England And the sayd<br />
shipps Company told the sayd Bellinger that his sayd shipp was<br />
full laden and had then aboard her more goods then shee could conve=<br />
niently carrie, and that therefore hee knew not where to stowe<br />
them unlesse it were abaft the Mast which would bee a meanes<br />
to [?cloy] up his gunnes soe that hee should not be able to use them if<br />
hee were sett upon by enimyes' or if stormie weather happened<br />
hee must bee forced to heave them over board or to that effect<br />
