Transcription with his said shipp to the Groine, the saiwith his said shipp to the Groine, the said two fflemish frigats<br /> came in thither a day two or three with their said prize before<br /> this deponents comming in thither, and saith that lying soe side by<br /> side with the ''Mary and Joice'' there, hee was sometimes aboard her<br /> and saith it is somewhat above two monethes since hee last saw<br /> and left her at the Groine. Amd otherwise negatively saving<br /> as aforesaid. To the third hee referreth himselfe to his foregoeing deposition, and<br /> otherwise hee cannot answer. To the fourth hee saith that the said William Warren and others<br /> at the Groine said and declared that the said shipp soe taken<br /> by the said two fflemish frigots was named and called the ''Mary''<br /> ''and Joice'', but this deponent never knew nor saw her before<br /> such his comming in thither. And otherwise hee referreth himselfe<br /> to his foregoeing deposition. To the fifth hee saith that hee staid with his said shipp and<br /> the wines therein at the Groine about foure or five dayes after receipt thereof<br /> aboard out of the ''Mary and Joice'' before hee came and departed thence,<br /> and saith that hee (to his remembrance) came thence with his<br /> said shipp and the said wines on or about the foure an<br /> twentieth (Newe stile) of Aprill last. And otherwise saving<br /> his foregoeing deposition hee cannot depose. To the 6th hee saith that after all the foresaid wines were<br /> laded and received into this deponents said shipp as aforesaid<br /> hee signed bills of lading for the same (videlicet the foresaid three<br /> billsm and noe other) and not before, one of which bills of lading<br /> hee saith hee had aboard his said shipp at the time of the<br /> said seizure by the ''Briar frigot'', the Captaine whereof hee saith<br /> tooke the same from him and kept it, and saith the effect<br /> thereof was an acknowledgment of receipt of the said two<br /> hundred and eight pipes of wine of the said Andries Aer[XXXXXen]<br /> at the Groine to be carried to Middleborow and there to bee<br /> delivered to the said Nicholas Clement, and thither hee saith<br /> the same had bin carried and delivered there accordingly if<br /> such seizure or other imp[XXXXXce] had not prevented it, And<br /> otherwise referring himselfe to the said bills hee cannot answer,<br /> not remembring whether it be in the said bills mentioned for<br /> whose account the wines were laded or not. To the 7th negatively for his part, and otherwise hee cannot<br /> answere, saving hee heard not whether the said wines were<br /> there condemned or iudged for prize or not. To the 8 hee saith hee cannot answer saving as aforesaid<br /> referring himselfe to his foregoeing deposition. To the 9th hee saith hee cannot answer thereto, saving<br /> when hee came to Plimouth hee saw that some of his shipps<br /> wines had bin taken out and away while shee was under the said<br /> seizure, but how much hee knoweth not.
