Transcription came and happened, and not by any fault Cacame and happened, and not by any fault Carelessness<br /> or insufficiency of or in the said Robert Clarke, or any of<br /> the Company of the said ship. And saith further. that by<br /> the Lawes and Customes used in the said River of Thames<br /> not any Anchors that belong to ships ought to Lye more then one Tide<br /> without a buoy and if an Anchor or Anchors shall lye without a b[?uoy GUTTER]<br /> more then one Tide, whatsoever damage happeneth<br /> (According to the Custome of the said River.) the ship or ships [?to GUTTER]<br /> whom the said Anchor or Anchors belongs, shall be liable<br /> Therefore, which hee knoweth for that hee this Deponent hath<br /> bin a seaman for theise 27 yeeres last.<br /> for all which time hee hath frequented the said River and f[urther GUTTER]<br /> Cannot depose./ To the 12th hee doth not depose/. To the 13th hee referreth himselfe to the Registry of this<br /> Court/. To the .14th. hee saith besides the Damages aforesaid the said<br /> Clarke and Company have sustained losse and damage in this deponents [XXXX GUTTER] to the<br /> Vallue of about twenty pounds Sterling, by reason of [XXX GUTTER]<br /> losse of Imployment of the said ship by meanes of the [XXXX GUTTER] And forbearance<br /> of his money, and further cannot depose/. To the 15th and 16th hee referreth himselfe to his foregoeing deposition<br /> and to the Lawe./. To the last hee saith his foregoeing deposition is true/. To the Interrogatories. [CENTRE HEADING] To the first hee saith hee was Masters Mate of the ''Warewell'' [?the GUTTER]<br /> time Interrate./. To the second hee saith that hee knoweth the said ship ''Suzan''<br /> and shee is of the burthen of about 230 Ton[?nes GUTTER]<br /> And saith that the said ship the ''Suzan'' did Lye and Ryde in a<br /> Convenient place where shipps usually Ryde and not farr from the ''Warewell'', And further<br /> cannot Answer/. To the third hee saith that the said Ship the ''Warewell'' came<br /> to an Anchor in the foresaid Place about foure a Clock in the<br /> morning of the second of August 1658: and it was [XXX GUTTER]<br /> about three quarters floud, and shee Satt upon the said [??Anchor GUTTER]<br /> when it was about three quarters Ebb, and further cannot<br /> Answer:/.
