Examined upon an Allegation<br /> given in on the behalfe of<br /> the said John Anderson<br /> Ninian Anderson and<br /> Company::/:: '''Rp. jus.''' '''Henry hart''' of ffalkirke [?neere ?Glascoe GUTTER]<br /> in Scotland Mariner aged 30 yeeres or thereabouts<br /> sworne and Examined./: To the first article hee saith that for and during all the monethes<br /> of July August September October November December and January last the arlate John Anderson senior Ninian Anderson and<br /> James Kerr (all well knowne to this deponent) being all Merchants of<br /> Glascoe, and Subjects of this Comonwealth were (as this Deponent verily beleeveth) and alsoe [?att GUTTER]<br /> this Present are the true and Lawfull Owners and<br /> Proprietors of the arlate ship the ''Golden Cock'' whereof<br /> Robert Thomson was and is Master and for Owners they were and are Comonly accounted<br /> And the said Anderson and Kerr have seriously told this Deponent that [?they GUTTER]<br /> bought the said ship at Rotterdam, and they of this Deponents knowledge<br /> paid the Customs for the Bulke of the said ship at [?Glascoe GUTTER]<br /> and made the said Thomson Master of her, in the<br /> moneth of September, last, And further cannot depose. To the second and third. hee saith that in the said moneth of<br /> September last, the said Owners of the said ship. did provide and<br /> cause to be Laden onboard the said ship ''Golden Cock'' at Glascoe<br /> in Scotland a cargoe of Herrings Butter and Tallowe to be<br /> transported in the said ship to Bourdeaux in ffrance, upon<br /> their Account, and there to be delivered to their ffactor who was<br /> to Lade wines on board the said ship upon their Account in<br /> proceed of the said outward Cargoe, and the<br /> said wines was to be brought in the said ship to Glascowe, and saith that the said ship having<br /> received the said outward Lading onboard departed and<br /> set saile with the same, and on the 6th of October last in her<br /> Course for Bourdeaux shee and her said Lading upon the high and open Sea were in<br /> a hostile and Piraticall manner seized by a ship called the<br /> ''Charls'' whereof one William Browne (who was her Lietenant)<br /> was then Comander her Captaine (called Morgan Jones)<br /> being left ashore, The Premisses hee deposeth being with the [??said GUTTER]<br /> ship the ''Hope'' whereof hee was Master) at Glascowe [XXX] by the ''Golden Starr'' all the time And said [XXX GUTTER]<br /> was taking in her said outward Lading, and being the same [XXX GUTTER]<br /> put on board her, and sawe the said Owners often come on board the<br /> said ship, and give order to the said Thomson touching the<br /> said Lading, and sailed from Glascoe in Company of the said<br /> ship ''Cock'' and was taken the same time and by the same<br /> ship. that the ''Cock'' was, And further cannot depose.
