Transcription To the 2d and 3d hee saith that that placeTo the 2d and 3d hee saith that that place where the said Ship<br /> the ''Phenix'' did soe ride at anchor as aforesaid, was and<br /> is a very usuall, and Comon place where Ships did<br /> usually ride, and lye in, And saith the said Ship the<br /> ''Phenix'' did there lye some Certaine dayes without<br /> doeing any dammage to, or receiveing any Damage from,<br /> any Ship or Vessell whatsoever, And saith that after<br /> shee had rid some Certaine dayes at the said place<br /> the arlate Ship the ''Consent'' came and sat upon<br /> the said Anchor belonging to the ''Phonix'' which lay<br /> to the Northward, And further cannot depose; for<br /> that hee was not then on board the ''Phenix'', nor sawe<br /> howe the said damage came to the ''Consent''. But went<br /> (about ?6 of a Clock of the Saturday arlate) on board To the .4.th hee saith that hee verily beleeveth that if<br /> the ''Consents'' Southerne Anchor had not broake<br /> from her Cable and gave way. shee would not nor<br /> Could both in any Probability have come and sat upon<br /> the ''Phenex'' her Northerne Anchor. and further<br /> Cannot depose:/: To the 5th hee saith that from Thursday: untill about seaven<br /> a Clock of the Saturday next followeing, the ''Phenix'' and the<br /> ''Consent'' did every tide winde about as the tide went<br /> and in all that time the ''Consent'' never Touched<br /> the ''Phenix'' or her Anchor or either of<br /> them, that this deponent knoweth of: And further<br /> hee cannot depose:/. To the 6th. hee saith that the said Anchors belonging to the<br /> ''Phenix'' were as aforesaid Cast out the one to the<br /> Northward and the other to the Southward and otherwise<br /> hee deposeth not To the 7.th hee saith that for many dayes before; and untill<br /> the said Damage happened to the ''Consent'', by her<br /> sitting uppon the ''Phenix'' her Anchor, there was only one<br /> boy onboard the ''Consent'' to looke to her, and saith hee<br /> beleeveth that if there had bin men on board her that<br /> would have veered and haled her the said damage which happened<br /> to the ''Consent'' might have bin prevented The<br /> foresaid premisses hee deposeth for that hee was and<br /> Continued on board the ''Phenix'', a great part of the time<br /> that she came to and Anchored in the said place, when<br /> hee went ashore in the evening of the said Saturday<br /> next before the said Damage happened And further cannot<br /> depose./.
