Examined upon an Allegation made in the Acts of Court<br />
on behalfe of the said Thomas Cowell,

'''Thomas Yoakeley''' of Saint Cathereines neere the<br />
Tower of London Mariner, aged 31 Yeeres or<br />
thereabouts sworne; and Examined./.
To the said Allegation hee saith and deposeth that hee well knoweth the<br />
ship the ''Thomas'' arlate, And saith that the arlate Mr Cowell<br />
and one Mr Canham Mr Reed and Michael Yoakeley thelder, and Michael<br />
Yoakley the Younger and this deponent, Set out the said Ship, about January 1653<br />
from this Port of London on a Voyage to bee made with her<br />
from hence to Roan, and to other places beyond the Seas and they<br />
the said Cowell Canham, and Reed, and the said Yoakeleys are the true and Lawfull Owners of her and<br />
by the Consent of thereof her said Owners went Master of her, and saith the said ship, (being in her Course for this<br />
Port and coming from Morlaix) was together with this Deponent, and Company<br />
seized by a Three Brest men of Warr; on or about the fifteenth of Aprill<br />
1654: and saith that hee hath bin Certainely in formed by Letters<br />
and otherwise that the said Ship ''Thomas'' was taken as aforesaid srescued and brought<br />
unto ffalmouth; And further Cannot depose:

To the first he saith that hee knowe the said Ship ''Thomas''. about<br />
two yeares before. shee was seized by the said three brest men of warr<br />
and sawe heer last in Brest harbour after the said time that she was seized and further saving as<br />
aforesaid hee cannot Answer./
To the second he saith that the ''Thomas'' had noe Great Gunns on board her<br />
at the time of her said seizure that this Deponent Knowth of, And further (saving<br />
his foregoeing deposition to which hee referreth himselfe) hee cannot Answer
To the last hee saith hee hath not seene the said Ship ''Thomas'' or any of<br />
her Anchors Cables. or sailes since her, being in Brest Harbour and<br />
further cannot answer./:
