66 yeares or thereabouts sworne and Examined<br />
saith as followeth./.
To the jst article of the Allegation hee saith and deposeth, that in or about the<br />
monethes of June July, and August 1649, the arlate Mathew<br />
Pennyer was Captain, and Comander of a certaine<br />
Frigott then Commissionated by his Majesty Charles the second<br />
by the grace of God King of England, Scotland, France and Ireland,<br />
defender of the ffaith et cetera, or by his Royall Highnes, James Duke<br />
of Yorke, but the name of the said ffrigott hee saith hee doth not<br />
now Certainely remember, but beleeveth that shee was then<br />
Called the ''Charles'', And further to this article hee saith hee cannot<br />
depose./.
To the 2d 3d 4th and 5th articles hee saith that in or about the foresaid months<br />
in the said Yeare 1649. the said Captaine Pennyer with his said<br />
ffrigott was brought into the haven of Calice in ffrance, by a ffrench man , or<br />
ffrenchmen of warr, which had seized the said ffrigott, off at Sea, with<br />
a Great Summe of money onboard her, and many utensills and necessaries<br />
as this deponent was Credibly Informed after the said ffrigotts bringing<br />
into the said haven of Callice but the Vallue of the same hee saith<br />
hee knoweth not, And saith that after the said Captaine Pennyer<br />
was with his said ffrigott brought ito the said haven, hee the said<br />
Pennyer was put into the Common Prison at Callice, and not allowed<br />
any Provision but what hee paid for, which hee knoweth for that hee was<br />
Agent for his Majesty of England at Callice, and frequently went<br />
to see the said Pennyer in the said Prison, And further saith that<br />
the said Pennyer was detained and kept in the said Prison for<br />
the space ofabout two or three months, and being then lett out<br />
were forced to depart thence without receiving any satisfaction for<br />
his said ffrigott, money, utensills and necessaryes seized in her or<br />
abuses done unto him, that this deponent Knoweth of. And further<br />
deposeth not./
To the last hee saith his forgoing deposition is true./
