said Jennings agreeing and<br />
undertakinge to desist from<br />

Lawe against the said Cole for the proffitts<br />
of his part of the shippe whereof hee<br />
the said Cole was master in case the saide<br />
Cole will give him an Account of the same<br />
in this Court and to with drawe his action here<br />
the said Cole did then presentlye give the said<br />
Jennings an Account thereof under his hands<br />
And thereupon the Judges with the consent<br />
of the said Cole did decree the said Jennings<br />
to be released from the Attachment of this<br />
Court under which he nowe is without any charges<br />
by him to be paid./

That the said James Jauncey is owner of<br />
one 4th part of the shipp the ''hopewell'' in this<br />
cause mentioned, and that the same was made<br />
over unto him by the said Thomas Jauncey in his<br />
life tyme and that he the said James Jauncey did<br />
afterwards accept the said part and lay clayme to<br />
the sme to his owne, and was generally reputed and<br />
taken notice of to be an owner of one 4th part of<br />
the said shipp, and that one 4th part of the goods<br />
brought in the said shipp from Guiny to the Bar=<br />
badoes was there shared for the Accompt of the said<br />
James Jauncey and desired him to be monished to<br />
pay one 4th part of the wages in this behalf due<br />
The said Clements dissentinge and alleadginge that<br />
the said James Jauncey hath not taken upon him<br />
the administration of the goods of Thomas Jauncey<br />
his brother deceased one of the part owners of the<br />
shipp The ''hopewell'' in the proceedings of this<br />
cause mentioned, but that the same hath bin and is in<br />
due forme of lawe setled upon Thomas Marsh Esquire<br />
and desired the said James Jauncey to be dismissed<br />
with expences and undertooke for his appearance<br />
