“IN THE NAME OF GOD AMEN I Sir Robert Abdy of Albins in the County of Essex, Knight and Barronett being well in body and in perfect mynd and memory (praised bz given to Almighty God)..

...And my body to the earth from whence it came to be buried in the vault of Stapleford Abbotts Church, with a moderate expend nothing of rings or things of that nature little mourning I mean but to my owne familie my sonne & daughter Pennington being included, and mymynd is that, my body be buried in the afternoon by day light as near my beloved wife as maybe And for such worldly estate as it hath pleased Almighty God plentifully to give andd after my debts payde which I hereby Charge to be honourably done, And my funerall charges paid and satisffied I give devise and bequeath the same as followeth unto my second sonne Roberte Abdy the summe of Two Thousand pounds of lawfull money of England And to my Third sonne Charles Abdy the somme of one Thousand pounds of like money and to my fourth and now youngest sonne Edward Abdy

My fifth sonne being dead the like somme of One Thousand pounds of like money All which respective sommes of money soe before bequeathed to my said second third & fourth sonnes I hereby will and order to be paid respectively to them my said three sonnes at their respective ages of three & Twenty yeares, And if any of them dye before he or they respectively attayning his or their respective ages of three and twenty yeares then the same respective sommes of money to him or them respectively given and bequeathed as aforesaid shall come to & he payable to the survivors & survivor of them part & part alike And myfurther will & mynd is That soo long as any of my said three sonnes shall live at home with my sonne John Abdy or shalbe at the Grammar Schoole my said sonne John Abdy shall maintayne them there with all moderate accomodating as if my selfe were alive And in case of any default or difference (which I hope there will not be) I desire and appointe my overseers herein after named to appointe a summe for every yeare for all or any of their maintaynances And I doe further will that those of my said three sonnes Robert Charles and Edward that shall goo to, and continue to study at some Colledge at either of the universities shall dureing his or their respective abod there be yearely paid and satisfied the respective sommes of fifeteen pounds p Anna a peece of lawfull of England for his and their respective maintenances And if they or any of them shall goe to & continue at any of the Inns of Court then I doe appoynt him or them soe continueing there the summe of three score pounds of like money p Anna a peece for his or their repectvie maintenances untill their respective porcōns to him or them hereby respectively given shalbe payable by this my will And if in case all or any of my said three sonnes Robert Charles & Edward shalbe mynded & resolved to be bound an apprentice to some merchant or merchants trades, or traders in London Then I doe appoint my Executors herafter named to binde them or such of them as shall define to be an apprentice or apprentices to such Master or Masters as my said Executors shall thinke fitt And I doe hereby will and appointe That my said executors shall pay for the binding of such Sonne or Sonnes that shall become bound as aforesaid for every sonne soe bound as aforesaid the somme of three hundred pounds at the least of to a Turky merchant, but if to any other merchant or Tradesman Then such somme or sommes of money for such sonne or sonnes soe bound as aforesaid not exceeding three hundred pounds as my said Executors shall thinke fitt And my mynd & will is that the respective porcōns herein before bequeathed to my said three sonnes Robert Charles and Edward shall not be diminished by the sommes hereby directed to be paid to them when respectively due And my further will and mynd is That if any of my said three younger sonnes shalbe mynded to study divinity and enter into holy orders for their better preferment and encouragement therein I doe hereby give and grant unto my eldest Sonne John Abdy, and to John Morris of London gentleman both of which I make Executors of this, my last will and testament, and the survivor of them And the Executors & administrators of the same survivor of them And the Executors & Administrators of the same survivor the two next presentacōns to all and every my Church livings And Advowsons in the County of Essex That shall happen after the deaths of the now respective incumbents To the intent & purpose That they the said John Abdy & John Morris and the survivors of them and the executors & administrators of the same survivor shall present to such a living soe falling voyd by the death of the now incumbent such of my said sonnes as shalbe soe quallified

And untill such qualificacion to such person or persons as my said sonne John Abdy and John Morris or the Survivor of them or the executors or administrators of the same survivor shall appoint voydable, nevertheless at such tyme as any of my said Sonnes shalbe admitted into holy orders
ITEM I give devise and bequeath unto my eldest daughter Katherine Abdy; yearly and every yeare, untill she shalbe married the yearely somme or payment of Threescore pounds of lawfull money of England To be paid unto her at fower the most usuall feasts or termes in the yeare That is to say the Nativity of Saint John Baptist Saint Michaell Church’s ?angell the Birth of our Lord Christ And Theanunciacōn of the blessede Virgin Mary by even and equall porcōns the first payment thereof to be made and begin on the first of the said feasts as shall next happen after my decease And in case my said daughter Catherine shall marry with the consent and good liking of my deare brother S:r Thomas Abdy Knight and Barronett, Sir John Branston of the honourable order of the Bath Knight Francis Branston esquire Serjeant at Law And my sonne in law John Pennington esquire, and my two executors or them greatest number of them Then I doe hereby give devise and bequeath unto my said daughter Katherine the somme of three thousand pounds of lawfullmoney of England to be paid her on her marriage And then the aforesaid yearely payment to her herein before bequeathed shall cease, And in case my said daughter shall continue unmarried, or shall marry without the consent of the said Sir Thomas Abdy Sir John Bramston Francis Bramston and John Pennington, and my executors or the greatest number of them Then for the better payment of the said yearely somme of Threescore pounds to my said daughter Katherine as aforesaid I her charge all my mannor of Masralsbury with the appurtenances in the County of Essex And all my messuages lands Tenements and hereditaments thereunto belonging with the payment thereof for her life if she continues unmarryed or marry without the consent of the aforesaid persons or the greatest number of them The sume to be paid quarterly in such manner as before as sett downe, And if my said sonne John or which soever of my said sonnes or his heires shall enjoy the aforesaid Mannor of Masralsbury and premises shall make default in payment of the said yearly somme of Threescore pounds or any part thereof Then I grant her power and full authority to enter into the said Mannor and premises, to recover the same by distresse, Or, to receave and taile the rents efects and proffitts thereof untill shee shalbe fully satisffied and paid her said yearely payment and all arrearages thereof which provision of Threescore pounds per Annum set herein before given her in case of not marrying or marrying without consent is to be in sattisfaction of the three Thousand pounds herein before bequeathed
ITEM I give devise and bequeath unto my second daughter Mary Abdy the sume of Three Thousand pounds of lawfull money of England to be paid her at the day of her marriage And untill such a marriage I appoint my said executors to pay unto her yearely and every yeare the summe of three score pounds of like money for and towards her maintenance at such dayes and tymes my said daughter Katherines Annuity is payable And I alsoe give dispose and bequeath unto my fourth and youngest daughter Elizabeth Abdy the like summe of three Thousand pounds of like money to be likewise paid her on the say of her marriage and untill such her marriage I appointmy said executorsto pay unto her yearely and every yeare for & towards

ITEM I give and bequeath unto my saide sonne in lawe John Pennington and my daughter Sarah his wife a peece of Plate of the value of Twenty pounds of lawfull money of England on which I will have my Arms engraved
ITEM I give to the poore of the paresh of Stapleford Abbott wherein I now live Twenty pounds of like money for an increase of the stock there to be disposed there amongst them as my said sonne John Abdy shall appoint and to the poore of the Parrish of Thordon Gauxxxx in Essex I give tenne pounds of like money
ITEM I give to and amongst five Orthodox Ministers that are old and poore Twenty and five pounds And to & amongst five widows that have bin the wives of Orthodox ministers that are now poore five 6 twenty pounds to be divided amongst them as my executors shall thinek fitt, And I give to Tenne poore boyes to bynde them apprentices in London five pounds a peece And whereas there is appeareing due by my books forty or fiftie pounds or somme such somme as for redemption of slaves out of Algier and Tannir (?) or other partes in Barbary I doe hereby oder my executors to pay that And I doe order them to pay fiftie pounds more of myne owne for the same intent and purpose Item I give to M:r John ?Cotty Minister of Stapleford Abbotts Cloth for a mourning gown
ITEM I give and bequeath unto my Clerke Robert ?Cotty the somme of Tenne pounds To such of my servants as shall have lived with and above seaven yeares I give five pounds a peece, including Anne Smith that is servant to my daughter And to such of my servants as shall have lived with me three yeares I give three pounds a peece And those that have not lived soe long as three yeares twenty shillings a peece To John Morris whome I have appointed one of my executors I give one hundred pounds of lawfull money of England And to my kinswoman M:rs Sarah Smarte the like summe of one hundred pounds of like monie And for the more regular and orderlie payment of all & every such debts as I shall owe at the tyme of my death and of all and every the Legacies & maintenances before herein bequeathed and appointed to be paid (except my daughter Katherines yearely payment, which I have charged upon Masalsbury) I doe hereby ?allott & appoint, in case all my personall estate will not extend to pay the same) That my Moyety of the mannor of Fishtofte & all other my lands in Fishstofte and Boston or elsewhere in the Countie of Lincolne, which I bought of Montague Earle of Lindsey And all those my mannors or Lordshipps of Landon otherwise Landon hall als Jeperack Shipwrack, which I bought of Montague earle of Lindsey And all those my messuages lands Tenements and hereditments in Landon Danbury Boreham Springfeild Much Baddow Little Baddow Moulsham East Haning fields West Haninggfields Pueleigh Prithwell & Sudminster pr any of them in the Countie of Essex which I bought of William Lord Maynarde and of Dame Anne Everard S:r Richard Evance Barronnett Charles maynarde Esquire and Robert Melbourne esquire or sonne of them shalbe sold And therefore to that end and purpose I doe here by give desire & bequeath thes said Moyety of the Mannor of Fishtoft and the said mannor of Sandon alias Sandon hall and Jepevark alias Shipwrack and all other the last mencioned messuages landes Tenements and hereditaments with there & every of these appurtenances to my said sonne John Abdy & John Morris and their heires and assignes forever upon the trust and to this intent and purpose That they the said John Abdy and John Morris or the survivor of them or the heires and assignes of the same survivor shall

& may sell & dispose of the same Mannors, messuages lands and hereditmants or soe much thereof as shalbe sufficient with my personall estate to pay alle my debts legaciesand maintyances before by me appointed to be paid and that with such speed as possible may bee That neither my debtors or legatees may be disappointed or anyways complayned further not being paid And upon true further trust that until such sale the rents and proffitts of the said last menconed Mannors and premisesshallbe employed towards the payment of my debts and the Legacies and maintenances hereinbefore appointed And if after all my debts and Legacies shall be paid there shall remayne any surplus of the money raised by the sale of the said mannors and lands or any parte of them or when mysaid debts and Legacies be paid there shall reamaine any part of the Mannorare xx lands unsold that I have appointed to be sold Then I give devise and bequeath all such residue of moneys and lands unsold (if any) to my said sonne John Abdy his heires and assignes forever to be an Xxx or their free dispose
ITEM I give and bequeath all that my mannor or Lordship of berwick Burnes with the rights members or appurtenanances thereof in the said County of Essex And alll other the messuages Lands Tenements and hereditaments whatsoever purchased by me of Arthur Lord Capell xxx Earle of Essex lying and being in Abbas Roothin and StXXX Rawthing or one of them in the said County of Essex To my said sonne John Abdy to hold to him my said sonne and the heires of his body léawfully to be begotten And for want of such issue Then I give devise and bequeath the same last menconed Mannor or Lordship and premises to my said second sonne Robert Abdy and the heires of his body lawfully to be beotten And for want of such issue to my said Third Charles Abdy And the heires of his body lawfully to be begotten And for want of such issue then to my fourth and now youngest sonne Edward Abdy and the heires of his body lawfully to be begotten And for want of such issue then I give declare and bequeath the same to the right heires of ?hee the said Robert Abdy forever And for the setling of all the rest and residue of my Mannors Messuages Lands Tenements and hereditaments in my name and blood soe long as it shall please Almighty God I heareby setlle and dispose the same as followeth

And for lacke of such issue then I give devise and bequeath the last before menconed Manners Lands and hereditaments and every part therof (except before excepted and Charged with the same Annuity to Katherine as aforesaid to my said second sonne Robert Abdy To hold to him the said Robert Abdy for and dureing the terme of his naturall life without ympeachment of, or for, any manner of waise And from and after the decease of my said sonne Robert Abdy Then to the first sonne of the body of the said Robert Abdy lawfully to be begotten, and the heires males of the body of such first sonne lawfully issueing

And for default of such issue Then to the second third fourth fifth & other sonne and sonnes of my said Sonne Edward Abdy lawfully to be begotten according to their priorities of birth and seniorities and the heires males of such second third fourth fifth and other sonne and sonnes lawfully issueing the eldest of such sonne & sonnes and the heires males of his body issueing being allways preferred before the younger and the heires males of their bodies issueing
And for lack of such issue Then I give devise and bequeath the same Mannors messuages lands tenements and hereditaments bequeathed to the aid John Abdy as aforesaid and every parte thereof except before excepted & charged with the aforesaid Annuityes to Katherine to the right heires of mee the said xx Robert Abdy forever
Nevertheless my express wil and mynde is notwithstanding the settlement and antayle aforesaid That it shall and may be lawfull to and for my said sonne John Abdy or for any other of my aforesaid sonnes or any of the heires males of their respective bodyes that shall in the actuall possession of the said Mannors Landes and premises by vertue of this my bequest aforesaid to settle and assure upon such wife or wives woman or women as he or they shall respectively marry any parte of the aforesaid mannors & lands and premises intayled as aforesaid for her & their respective life or lives for her or theire respective Joynture or Jointures soo as such Joynture or Joyntures exceed not the value of six hundred pounds per Annum And soe as my mannor or Mansion house and Parke of Albins be not any parte or parcell of any such Joynture or Joyntures to be made by vertue of ther presents (sic)
All the rest and residue of my goods and chattells rights and credittsnot herein before bequeathed after my debts legacies & funeral charges shalbe paid and satisffied I give devise & bequeath the same to my said sonne John Abdy
And I doe hereby make ordayne & appointe my said sonne John Abdy and the said John Morris executors of this my last will and Testament And I doe desire my said loveing brothers Sir Thomas Abdy and SirThomas Bramston and the said ffrances Bramston to be overseers of this my will And I doe hereby revoke all former wills by mee made In witnes whereof to this my last will and Testament xxx in the Eight foregoing sheets and the part of a sheete of paper sxxx at the upper end thereof with a string and sealed with my seale
And to the bottom of every sheete I have subscribed my hand and to this have sett my hand and seale this eight and twentiethday of Aprill 1670 And in the two and Twentyeth yeare of the raigne of our now soveraigne Lord Charles the second Robert Abdy Signed Sealed published and declared by the above named Sir Robert Abdy for his last will and testament in the presence of Ro: Totty Lawrence Wickens William Stokes
A CODICILL annexed to the last will and testament of me S:r Robert Abdy which I appoint and order to be taken as parte & parcell of my last wil:-
FIRST I GIVE AND DEVISE To my Nephew Anthony Abdy esquire eldesst sonne of my brother Sir Thomas Abdy knight and Baronnett the somme of Twenty pounds of lawfull money of England And I give to my Nephew Anthony Brampston the eldest sonne of my brother in lawe Sir John Brumston Knight of the Bath the like somme of twenty pounds of like money And I give to my Nephew and Godsonne Robert Parkhurst esquire eldest sonne of S:r Robert Parkhurst knight my brother in lawe The summe of twenty pounds of like money To my god daughter M:rs Abigall Abdy one of my brothers

Sir Thomas Abdyes daughters the somme of xxx pounds of like money To Robert Harlley and his wife to each of them xxx five pounds of like money And I give to Richard Seagar and his wife five pounds a peece And where as there was given to pay the daughters Katherine Mary and Sarah by theire Grandfather Sir John Gayer Knight one hundred pounds a peece which I have occupied for their use And whereas I have givenby my said will to the said Katherine upon such termes as therein is mencioned the sume of three Thousand poundsnow my will and meaning is That mysaid xxxxxx daughters Katherine & Mary shall before she or they receive their respective porcons of Three Thousand pounds unfortunately discharged Sir Roj : Gayer Knight of the Bath my Brother in Law of and for the xxxx use xxxx summes of one hundred pounds by writeing under there xxxxxx his hand and seale it being my intention that the xxxxxx sommes of one hundred pounds before menconed to be given them by Sir John Gayer are added to each of the respective sommes of Three Thousand pounds a peece to them given by my will, And whereas I have married my said daughter Sarah to John Pxxxx xxxx esquire and have given and secured to him for her portion the summe of Three Thousand pounds without takinge notice of the said one hundred pounds given her by her grandfather w:ch intended to be included in the said Three Thousand pounds And though I remember I did not speake to him of it before his marriage yet I doubtnot but hee will give a discharge for the sume to others and Sir Ro: Gayer merchant receaving of from him or any executor having injoyned my said daughters Katherine and Mary to do the same upon their receiving of the respective summes of 3000:ll to them respectively given by me In witnes whereof to this my Codicill annexed to my will which I declare to be part thereof I have sett my hand and seale this eight and Twentieth day of May 1670 And in the Two and Twentyeth yeare of the raigne of our xxx soveraigne Lord King Charles the second & our XXXXXX
