Transcription

a sentence diffinitive in writinge which the Judges did
read give and promulge and did pronounce decree declare
adjudge condemne and doe in all things as in the same
is contained in the presence of the said Clements dissentinge
and preotestinge of the nullitie and greivance and of
appealinge. etcetera/.

Which day the said Suckley
alleadged that the said Cheeke
hath given a libell in this
cause in the Acts of this Court
longe since but hath not brought in
the same Wherefore hee prayed the
said cause to bee dismissed with expences in
the presence of the said Cheeke consenteinge to
the dismission of this cause in case hee shall not
give in his libell into the Registry of this Court
by Munday next at noone Whereupon the Judges did
exXXXXXX etcetera dismisse this cause with expences in
case the said Cheeke shall not leave the said Libell
in the Registry of this Court by Munday next att
noone./

Which day the said Cheeke
desired that the said Swan
might bee ordered by this Court
to pay and satisfy unto the said Scott
and the rest of the marriners of the
shippe the {BLANK IN ORIGINAL MANUSCRIPT} their respective wages
due for their service in the said shipp the voyage
in question in the presence of the said Suckley appearing
for the said Swan and makinge himselfe partie for
him dissentinge and alleadging that one William
Whittle was the freighter of the said shipp the
voyage in question whoe refuseth to pay the freight
sue for the said shipps service the voyage in question
whereby hee is disabled for payment of the marriners
wages, Whereupon the Judges at Suckleys petition
did decree the said Whittle to bee monished to appeare
in this place upon wednesday next in the afternoone
to show cause if any hee hath why hee should not pay
the freight due for the service of the said shippe the
voyage in Question that thereby the said marriners
may bee paid and satisfyed such wages as the Court
shall thinke fitt to adjudge unto them and att Cheekes
petition the Courte did assigne to heare this cause
the same time in this place and monished the said
Swan to bee then and there present./.
