IN THE NAME OF GOD AMEN I Samuell Dawe (sic) of Wotton Underedge in the County of Gloucester Clothier being Sicke of body but of perfect memory praysed bee God doo make and ordaine this my last will and Testament in manner and forme following

FIRST I Comend my Soule into the hands of God my maker being assured through the merritts of Jesus Christ to bee made partaker of Eternall life, My body to the Earth of which it is made to be decently buryed in Christian buryall in such order as I have by word of mouth declared to my Executrix overseers hereafter named as they shall thinke fitt

ITEM whereas I am possessed of a messuage or Tenement and divers lands thereunto belonging in xxxartely in the parrish of Wotton Underedge aforesaid for Lease for the Tearme of fowerscore and nineteen yeares if I Mary my wife and Robert my Sonne or any of us so long live I give all the said Messuage or Tenement & lands unto Mary my wife dureing so long time of the said Terme as shee shall happen to live and after her decease I give the same unto my said sonne Robert dureing all the Residue of the said Terme then to Come

ITEM Whereas I am likewise possessed of an other Messuage or Tennement and diverse Closee lands called ?Walcome in the parish of Wotton Underedge aforesaid by Lease dureing the Residue of a terme of ninety nine yeares if I and my brother Thomas Dawe or either of us soe long live My will is that an (sic) new Estate be purchased by my Executrix (out of the personall estate I shall leave her) of the same for the lives of my said wife and my son Robert and that my wife hold the same dureing her life And after her decease that my said sonne Robert hold the same dureing his life & that uppon on the granting of Such now Estate the ould Lease bee Surrendered

ITEM as concerneing my house wherein I now inhabit in the Burrow of Wottomunderedge aforesaid whereof I am possessed by lease for fowerscore and nineteen yeares if I Abraham Dawe and Richard Lyet shall so longe live and as concerninge all my household goods therein My will is that my wife shall hold the said house and have the use of all my said household goods therein untill my said Sonne Robert shall have and enioy the said house dureing all the residue of the said Terme thereof Then to ?Come and all my aforesaid household goods as his owne goods and ?Chattels for ever and if my said wife after his decease shalbee againe married before my said Sonne attaine that age then my will is that all my said goods bee imediatey delivered to my overseers how after named to my said Sonnes use And if it happen my wife shall go before my Sonne attaine the aforesaid Age That then immediately after my wifes death my sonne shall enter into the said house and hold the same dureing all the then residue of the Terme thereof then to come

ITEM Concerneing my messuage Tennements or ffarme and Lands in Little Badmanton in the County of Gloucester whereof I am likewise possed which I hould by Lease for forescore and nineteen yeares if my said sonn Robert and Richard Hiett & Johnathan Hiett Sonnes of Richard Hiett or any of

Them I shall soo longe live, My will is that my said wife shall hold the same dureing three yeares next after my decease if she Continue so long a widdow and after y:e said three yeares expired orifin case my wife shalbee married within the said three yeares I give and bequeath all my said messuage Tenements or ffarms & lands in little Badmanton which I hold by Lease as aforesaid unto my said Sonen Robert dureing all the residue of my said Terme and estate therein which at the end of three years next after my decease or at the marriage of my said wife within these three years shalbee to come and unexpired And if it shall happen that my said Sonnn Robert shall dye before he shall attaine the Age of Tenn yeares Then notwithstanding any former gift or bequest by me herein before made I give and bequeath the said messuage Tenement or farms & Lands in Little Badmanton aforesaid to Jonathan Daws and Abraham Daws Sonnes of my brother Thomas Daws and unto Richard Hiett and Jonathan Hiett Sonnes of my brother in Law Richard Hiett dureing all the residue of the aforesaid Terme thereof which shalbee then to come & unexpired

ITEM I give to my said Sonne Robert Daws three hundredd pounds of lawfull English money and also fiftie pounds more of like money given him by the will of my mother Maude Dawe in all three hundred and fifty pounds to be paid to my overseers to my said Sonnes use or to bee disposed of them & mine Executrix in such sort as I shall hereafter hereon appoynte within three yeares next after my decease but and if my wife shalbee married before the end of three yeares next after my decease Then my will is that the said three hundred and fifty pounds bee paid to my overseers to my Sonnes use at the day of my said Wifes marriage the same three hundred and fifty pounds to be paid by my said wife Mary whom I make and ordaine executrix of this my last will and Testament And my will is that the said three hundred pounds & fifty bee disposed of by my overseers with the likeing and advice of my Executrix either att Interest to the Chamber of Bristoll till my Sonne shall attaine the Age of one and twenty yeares or bee in a Capacity to dispose of the same as also to bee laid out in purchase of some Lands of inheritance in fee simple or by lease to my said Sonne Robert as shall seeme good in the discretion of my Executrix and overseers and if my said Sonne shall happen to dye before he attaine the said Age of Tenn yeares And that my said wife bee then liveing my widowe unmaried I give one hundred pounds of the said three hundred and fifty pounds to my said wife and two hundred and fifty pounds residue thereof I give to such Children of my brother Thomas Daw and brother in law Richard Hiett as shalbe then liveing to bee equally devided amongst them

ITEM I give to M:r Joseph Boden Minister to preach my funerall Sermon forty shillings I give to every of the poore people that shalbee liveing in the auld Almes house at my death one shilling a peece

ITEM I give to my three Godchildren Jonathan Hiet forty shillings to Richard Winston Twenty shillings to Samuell ?Lokner twenty shillings I gvie to Robert ?Ewn the drawer Twenty shillings and one of Suits of apparell I give to my Cosen Richard Daws sonne of my uncle Thomas daws tenn shillings and my gray Cloke

ITEM if my servant John Tidman shall serve out his time honestly and bee dutifull to my wife then I give him forty shillings to be paid at the end of his time

ITEM I doe will and appoynt that my said Executrix shall pay and discharge all legacies and somes of mony given by the will of my Late Mother Maude Daws unto whome I was Executor as shalbee unpaid at my decease And I doe nominate and appoynt my father in Law William Tyler the Elder and my

Brother in law William Tyler the younger or my brother Thomas Daw and my brother in law Richard Hiett overseers of this my will desireing them to take Care to see that the same in every thinge bee performed my will is that according to my Feofees one of the lives mentioned in my howse in the Burrow by which I hold the same to be exchanged by me Executrix at her charge for the life of my sonne Robert to bee held and enioyed by my wife and my sonne as before is limitted and expressed

In witnesse whereof I have to this my last will and Testament sett to my hand and Seale & published the same the eigth day of January In the yeare of our Lord one Thousand Six hundred fifty & five

THIS WILL was proved at London the fowre and Twentieth day of May one thousand six hundred fifty six before the Judges for probat of wills and granting administrations lawfully authorised by the oath of Mary Dawes the Relict of the said deceased and sole Executrix named in y.e said will To whome Administration was granted pr she being by Commission first truly to Administration
