said Batts account, and these Rendents bel … said Batts account, and these Rendents beleeve that<br />
the same were entred in the Boateswaines booke arlate<br />
but where the said booke now is, these rendents nor<br />
any of them doe not know. but they<br />
beleeve that the 1500 peeces of eight mentioned in<br />
their precedent answeares made to the fifte articel of<br />
this allegation were entred into the said Middletons<br />
Booke as receaived in part of freight as in their<br />
said answeares to the said fift article of this allegation<br />
whereunto they refer themselves is expressed And<br />
otherwise they nor any of them doe not nor doth<br />
beleeve the said pretended position to be true in any<br />
part thereof.
To the sixteenth position of the said pretended allegation<br />
they and every of them doe answeare and beleeve<br />
that the arlate Thomas Middleton was never<br />
required to signe and did not signe or deliver any<br />
bills of lading for the pretended goods arlate And<br />
that after the arivall of the said shipp to this<br />
port of London the arlate Thomas Middleton<br />
and these Rendents did procure the said shipps<br />
lading to be arrested by vertue of a Warrant out of this<br />
Court for and towards theire satisfaction for<br />
the freight in this suite demannded and that after<br />
the said arrest videlicet on the first day of July 1645<br />
the said Batt gave bayle to answeare the<br />
action and thereupon all the said goods soe<br />
arrested were by the order and decree of this<br />
Court discharged from the said arrest and were<br />
all of them as they beleeve delivered to the said<br />
Thomas Batt and into his possession and they<br />
further referr themselves to the Registry of<br />
this Court And otherwise they nor any Of them<br />
doe not nor doth beleeve the said pretended position<br />
to be true in any part thereof./
