Transcription said Vessell and goods, was necessitated asaid Vessell and goods, was necessitated and by Gods assistance did safely<br /> bring the said Vessell to Saint Lucars in Spaine being the first Port that<br /> by the permission of Gods wind and weather they could attaine unto<br /> and being arrived at Saint Lucars aforesaid, one Mr Richard duck Merchant<br /> there resident and Correspondent to and of the said producent, did in this<br /> deponents presence and hearing (having sent for this deponent and the said Master)<br /> proffer to furnish the said Master with such moneyes as should bee<br /> found requisite for the reparation of the said shipp, and performance<br /> of her said intended Voiage for Palma, particularly offering to furnish<br /> him the said Master with one Thousand dollars to the intent aforementioned<br /> withall declaring to the said Master, that a very great dammage would<br /> accrew to the said producent, in case the said shipps lading were not<br /> delivered according to order at the said Port of Santa Cruz, and the<br /> said Mr Richard duck did then also produce and show unto this deponent<br /> a letter of advise, which hee affirmed hee had received from the said<br /> producent, intimating that the said producent had a lading of wynes readie<br /> at the said Port of Santa Cruz for the relading of the said shipp for<br /> England in returne of the outward lading, or words to that or the like<br /> effect, But as to the particulars of the goods mentioned and specified<br /> in the said schedule or the respective valewes thereof hee saith hee cannot<br /> depose, having noe knowledge thereof. And further cannot depose:- To the 4th article of the said Allegation, and the second schedule being a Chaarter<br /> party thereunto annexed and now seene and perused by this deponent hee saith<br /> that hee this deponent was not present at the signing or sealing of the said<br /> Charterpartie, And further cannot depose:-/ To the 5th hee saith, hee well knoweth as being Pilot as aforesaid of the<br /> said Vessell the ''John and Elizabeth'' the Voiage in Controversy, that the<br /> said shipp after her disaster aforesaid, might very well have been<br /> repaired, and fitted and sett out to sea from Saint Lucars to proceed upon<br /> her former designe for Palma, and that in a very short time, if<br /> the said Master had condescended to and accepted of the offers made unto<br /> him to that purpose by the said Mr Richard duck, but saith that of<br /> this deponents certaine knowledge, the said Master did stubbornely and<br /> pertinaciously refuse to proceed upon the said Voiage, notwithstanding that<br /> both the said Mr duck did very much endeavor to perswade him, and that<br /> this deponent constantly proffered his service to the said Master for the<br /> accomplishment of the said Voiage. And further cannot depose:-/ To the 6th hee saith, That the said Edward keene did lett out his<br /> said Vessell to freight at Saint Lucars to transport goods thence for this<br /> Port of London, whereas of this deponents knowledge and to the best of his<br /> Judgement hee the said keene might as well have performed the Voiage<br /> and designe for Santa Cruz.
