To the tenth he saith he cannot answer to this Interrogatory eyther <br />
affirmatively or negatively as this thereby required, for that he is <br />
wholly ignorant what the common opinion of mariners is in the case<br />
putt and suggested in this Interrogatory. and saith he never heard that<br />
case argued amongst Seamen and knoweth it is not the case or matter<br />
of fact now in question.
To the eleventh he saith he was aboard the ''Golden Starr'' after she came <br />
into the ''Hope'' and not before, and tooke out of her a small whipsaw of <br />
the value of 2 ''s'' or thereabouts and nothing else. and saith severall<br />
of the Companies of the ''Waterhound'' and ''Advantage'' were aboard the <br />
''Golden Starr'' before she came into the River and afterwards, and he doth<br />
beleive that severall things were by then taken out of her but by<br />
whom in particular, what things in particular, or to what value he saith<br />
he cannot depose. And otherwise he cannot depose.
To the twelfth he saith it is usuall for any shipp att sea being haled by<br />
another shipp who weares false colours and thereby gives suspition of being<br />
an enemy or pirat to stand upon the defensive guard. but the sayd shipp<br />
''Advantage'' did not weare any false colour when she haled the ''Golden Starr''<br />
as aforesayd but the English colours onely.
To the thirteenth he saith if the sayd shipp ''Morning Starr'' prove prize he<br />
expecteth a share as Carpenters mate of the ''Advantage frigot'' according <br />
to the Lawes and provisions made in that behalfe, and not otherwise. and <br />
further he cannot depose.

saith that the arlate shipp the ''Advantage'' Captaine Mills Commander and<br />
the ''Waterhound'' Gyles Shelley Captaine in the month of ffebruary 1652<br />
about 3 or 4 days after Portland fight did take and surprize a certayne<br />
shipp called the ''Morning Starr'' having a golden starr in her sterne<br />
being the shipp ''Golden Starr'' arlate, upon the English Coast off of Beachy<br />
about four leagues from the English shoare, And saith the ''Advantage''<br />
