Transcription The third day of February <u>1654<The third day of February <u>1654</u>:- [CENTRE HEADING] Richard Rice James Cole and Companie}<br /> against the shipp called the ''Charity'' of which}<br /> Robert harrigate was Master and against}<br /> George Grigg et cetera Suckley ffrancklyn} Examined upon an Allegation on the behalf of<br /> the said [?Rice] and Companie./ '''Rp j,us''' '''William Evans''' of New-Castle upon Thyne<br /> Mariner aged 32 yeares or thereabouts a Wittnes<br /> sworne and examined./. To the first Article of the said Allegation hee saith and deposeth, That in the<br /> yeares <u>1651</u> and <u>1652</u>. arlate and moneths therein respectively concurring<br /> the arlate Richard Rice James Cole Garrett Starkey Robert Cooke<br /> Miles Barnes and Companie all inhabitants of New-Castle upon Tyne<br /> were Owners and lawfull Proprietors of the shipp the ''Charity'' arlate and<br /> of her tackle apparrell and furniture, and for such they and the arlate<br /> Robert harrigate her Master were then commonly accompted and reputed at<br /> New-Castle, Which hee knoweth for that in or about the said yeare<br /> <u>1651</u>. the said shipp being taken and brought up as a Scotch Prize<br /> to Newcastle, was there publiquely sold to the said harrigate for the<br /> accompt of himself and others of Newcastle, who continued in the<br /> peaceable possession thereof. And further cannot depose saving that this<br /> deponent served under the said harrigate in the said shipp for about a yeare and a halfe:- To the second article hee saith and deposeth, That in the yeare <u>1652</u>:-<br /> the said shipp being at ffalmouth, this deponent there left her under the<br /> Conduct of the said Robert harrigate, who as this deponent credibly heard<br /> did shotly after saile her from thence to Waxford in Ireland, from<br /> whence, as hee hath also credibly heard, shee was in her passage thither<br /> intercepted by a dutch-shipp which had no Commission. And further<br /> cannot depose, not being in the Voiage in question./ To the third hee saith and deposeth, That about nyne moneths since<br /> as this deponent now remembreth, hee this deponent in Companie with the said<br /> Richard Rice one of the Owners of the Vessell in question, went aboard the<br /> same shee then lyeing at or neere Saint Saviours dock in the River of<br /> Thames, where this deponent well observed, and tooke serious notice of the<br /> said shipp, and of her fashion and fabrique, and thereby knoweth, and did<br /> then declare aboard the said shipp in the presence of the then Master<br /> of her, that shee was the shipp ''Charity'', whereof the said harrigate<br /> had been Master and hee and the said Rice and others the Lawfull Owners<br /> of the same, and that it was one and the same shipp ''Charity'' belonging to<br /> such Newcastle men as predeposed, and that hee well knew her so to be<br /> having sailed sewerall Voiages in her. And further hee cannot depose/:- To the 4th hee saith, hee referreth himself to the Acts of this Court<br /> And further cannot depose./.
